Present: John Angotti (Chairman), Francis Duzenack (Zoning Administrator), Larry Bruno (Vice-Chairman), Carolyn Vogrinec (Secretary), Alfred Richens, Laurel Marinos, Penny Sampinos, Gary Lyon, Joe Piccolo

Meeting convened at 6:00 P.M.


I. MINUTES OF DECEMBER 14, 1998

Chairman Angotti requested a correction be made on the agenda date for this meeting. The date should read January 11, 1999. Joe Piccolo requested a correction on Item VII, Paragraph 1, Line 10, which should read "Those present feel this will be a nice addition to Price City."

Larry Bruno requested a correction on Item IX, Conditional Use Permit for Fab Right. The motion was made and approved, contingent upon an inspection of the building by the Price City Fire Chief and Building Inspector.

Joe Piccolo called attention to Item VIII, Conditional Use Permit - Single Lot Subdivision for R. L. Krompel. He understood that after approval of the single lot subdivision, there was some discussion leading to a minute entry that would not allow another single lot subdivision to be done without planning the remainder of the development. He was not in attendance, but did not see this entry in the minutes. Mr. Piccolo indicated he would like something written into the minutes so that another subdivision cannot be done on this property without having proper plans for traffic, utilities, etc. The motion should read "Following discussion on this project, Larry Bruno moved to forward a favorable recommendation to Price City Council for a Conditional Use Permit for a Single Lot Subdivision at approximately 1400 East Sagewood Road for R.L. Krompel, however, any further development on this piece of property will require a subdivision master plan." Joe Piccolo made a motion to approve the minutes of January 11, 1999 as corrected. Penny Sampinos seconded and the motion carried.


II. CONDITIONAL USE PERMIT - SIGN

SOUTHWEST SILKS - LORI PUGLIESE, OWNER
214 EAST 100 NORTH - 4' X 8' LIGHTED SIGN

Ms. Pugliese told Commission Members that her business was expanding and she was relocating to the above address. Francis Duzenack indicated her sign will meet all the size requirements and be mounted on the roof of the building. There were no concerns and Larry Bruno moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Sign - for Southwest Silks. Gary Lyon seconded and the motion carried.


III. CONDITIONAL USE PERMIT - SIGN

COBRE TIRE - RANDY OSIER, MANAGER
935 EAST 100 NORTH - SIGN FOR TIRE SHOP IN CAR CARE CENTER

Joe Piccolo indicated that since he is the owner of the above mentioned property, he will abstain from voting due to a conflict of interest. Mr. Osier indicated they are still in the process of moving and a sign has not yet been decided upon. He had hoped he would have the necessary information in time for this meeting, however, it is not yet available. The Car Care Center is built and approved for automotive related uses, so the business license has been processed. After some discussion, it was decided that more information is needed before approval can be given for the sign. Gary Lyon made the motion to table the matter until such time as all information concerning the sign is available and brought before the Commission. Alfred Richens seconded and the motion carried.


IV. CONDITIONAL USE PERMIT - FREE STANDING SIGN

MAD MAN BASSO AUTO SALES - 396 SOUTH CARBON AVENUE

In the absence of Mr. Basso, the information was presented by Francis Duzenack. Mr. Basso is planning a 4' x 8' lighted pole mounted sign on the corner of 400 South and the west side of Carbon Avenue. He has been in contact with UDOT concerning compliance as Carbon Avenue is a State Highway and they have given their approval. The size of the sign meets all requirements and the set back is six feet from the sidewalk. It will not overhang the right-of-way and clearance under the sign meets the ten foot minimum clearance limit, so there is no restriction of traffic visibility. The final drawings for the sign are not yet available, but in talking with Mr. Basso, the sign will comply with all Price City Land Use Management and Development Code Regulations. After a short discussion, Alfred Richens moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Sign - for Mad Man Basso Auto Sales. Larry Bruno seconded and the motion carried.


V. CONDITIONAL USE PERMIT

UFX TECHNOLOGIES - SANDRA BAIRD, OWNER

Francis Duzenack indicated the applicant had called and asked to be placed on the next agenda. They are still searching for a suitable location. Because of the illegibility of the application and the fact that a new address is likely, Alfred Richens recommended a new application be completed. After some discussion, Alfred Richens made a motion to table this issue until the next meeting. Penny Sampinos seconded and the motion carried.


VI. STAFF

A) Francis Duzenack provided the Commission with current information on the Youth Treatment Program sponsored by Country Cottage Corporation. He will keep the Commission abreast of the situation and any changes that may occur.

B) Joe Piccolo feels there is a need to revamp the Price City Land Use Management and Development Code to read that house front doors must face Price City streets. He would like permission to have Price City Attorney Nick Sampinos address that issue and have the change made as soon as possible. He also indicated there are several areas in Price City where there will be some in-fill subdivision of property. He would like the Code to state that any in-fill development must present subdivision master plans to the Planning and Zoning Commission. Francis Duzenack indicated he will research the law on single lot subdivisions and report back to the Commission. Mr. Piccolo feels both of these two matters are in order and should be done immediately. Penny Sampinos told the Commission that part of the responsibility of Planning and Zoning is to make the community look as attractive as possible and she feels these changes should be put in place. Francis Duzenack indicated there were several other changes to be made and a final list will be prepared and returned to Planning and Zoning for approval. There was some discussion on these changes.

C) Joe Piccolo told Commission Members that Richard Tatton is the newly named Councilman replacing Councilman Steve Bringhurst.

There was no further business and the meeting adjourned at 7:00 P.M.
