Present: John Angotti (Chairman), Francis Duzenack (Zoning Administrator), Alfred Richens, Carolyn Vogrinec (Secretary), Laurel Marinos, Penny Sampinos, Gary Lyon, Joe Piccolo

Excused: Larry Bruno, Vice-Chairman

Meeting convened at 6:00 P.M.


Commission Member Joe Piccolo indicated he had two items on this evening's agenda, Items IV and V, and would step down when they were presented due to a conflict of interest.

I. MINUTES OF JANUARY 11, 1999

There were no corrections or changes and Penny Sampinos made a motion to approve the minutes of January 11, 1999 as read. Laurel Marinos seconded and the motion carried.


II. HOME OCCUPIED BUSINESS

INSPECTION SECURITY - DAVID PAUL SPIVEY
166 SOUTH 200 EAST - BUILDING INSPECTION SERVICES

Mr. Spivey told the Commission that he has a background in all types of construction. He feels there are people, buying and selling houses, and looking for qualified individuals to inspect homes for any problems. Joe Piccolo asked if a state license or bond was needed to perform these services. Mr. Spivey indicated a State License was not needed, however, he plans to carry Errors and Omissions Liability Insurance to cover his business. There were no further questions and Alfred Richens moved to forward a favorable recommendation to Price City Council for the Home Occupied Business of Inspection Security. Gary Lyon seconded and the motion carried.


III. CONDITIONAL USE PERMIT - BUSINESS & SIGN

Because Mr. Randall was not in attendance and following discussion on the condition of the building involved, it was decided to table the matter. Alfred Richens made a motion to table this item until the next meeting. Joe Piccolo seconded and the motion carried.


IV. CONDITIONAL USE PERMIT ONE LOT SUBDIVISION

JOE PICCOLO - 911 EAST 100 NORTH
SUBDIVISION OF PROPERTY TO SEPARATE  CAR CARE CENTER FROM LARGER PARCEL OF PROPERTY

Mr. Piccolo appeared before the Commission to request a one lot subdivision. He indicated the property was originally constructed on 15 ½ acres. However, the Care Care Center sits on 10 1/4 acres and must be subdivided from the 15 ½ acres. In order for Mr. Piccolo to obtain financing for the Car Care Center, Price City requires this property be subdivided from the original property. It was not subdivided when it was initially built, so the Car Care Center property description is still shown as being within the middle of the 15 ½ acres. There will be no residential buildings within this area as it is zoned CD. Mrs. Olivetto is keeping 5.38 acres on the west side of the existing business and selling the rest to Mr. Piccolo. Francis Duzenack explained it is a City Ordinance as well as a State Law that, in order to subdivide the property and create a new lot, Mr. Piccolo must have the approval of Price City Council and a recommendation from Price City Planning and Zoning Commission. He also indicated everything shown complies with Price City Land Use Management and Development Code and is basically an approval that is needed to subdivide the property, allowing both owners of each property to have a buildable lot. Following discussion on the matter, Alfred Richens moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - One Lot Subdivision for Joe Piccolo. Penny Sampinos seconded and the motion carried.

Francis Duzenack recommended Mr. Piccolo include Price City Council approval in the legal description of the Property Deed, being certain it is mentioned in the deed itself.


V. TEMPORARY CONDITIONAL USE PERMIT

JOE PICCOLO - REQUEST FOR TEMPORARY USE OF UNPAVED PARKING LOT ON THE WEST SIDE OF THE CAR CARE CENTER

Mr. Piccolo appeared once again before the Commission to request a Temporary Conditional Use Permit for use of an unpaved parking lot on the west side of his business. He indicated he had planned on paving the lot this summer, however, the funds are not there at this time. He now plans to pave in one to two years. It is prepared for pavement at this time and should be finished one year from this summer. He would like to have a year of temporary use of the parking lot, at which time, he will report back to the Commission and ask for additional time if necessary. Francis Duzenack indicated our Code allows the Planning Commission to go up to two years time, which is the maximum for a temporary use of this nature. There was some discussion on the matter and Gary Lyon moved to grant a Temporary Conditional Use Permit for the use of the unpaved parking lot on the west side of the Car Care Center for a period of 18 months. Penny Sampinos seconded and the motion carried.


VI. STAFF

A) Jeff Richens of PRWID appeared before the Commission to discuss the Waste Water Survey put out by the District. He would like to have a survey attached to each Conditional Use Permit for commercial application in order to help PRWID do their job. Joe Piccolo recommended adjusting the Conditional Use Permit to indicate to Planning and Zoning that the Waste Water Survey has been completed and sent to PRWID for approval. Mr. Duzenack indicated the change will be made to the permit application.

Mr. Richens told the Commission that PRWID would like to have sampling manholes at all commercial connections known to store and use chemicals, solvents, etc. and reiterated the importance of cooperation concerning this effort. There was some discussion on both of these matters.

B) City Planner Vern Jones was present at the meeting and indicated he was here to observe and become more involved in commercial developments within Price City.

There was no further business and the meeting was adjourned at 6:45pm.
