Chairman Angotti thanked Vice-Chairman Larry Bruno for presiding over the March 6, 2000 meeting in his absence.

 

1.                   MINUTES OF MARCH 6, 2000

 

There were no corrections or additions and Gary Lyon moved to approve the  minutes of the March 6, 2000 meeting as read.  Laurel Marinos seconded and the motion carried.

Mr. Alcon appeared before the Commission explaining he delivers his products and no customers come to his home.  Advertisement is by word of mouth or fliers and he has no plans for a sign at this time.  There were no concerns and Larry Bruno moved to forward a favorable recommendation to Price City Council for the Home Occupied Business - Office Use Only  - Jesse’s Darts.  Penny Sampinos seconded and the motion carried.

Mr. Cook explained he had been in business partnership prior to this time, but he is now the new owner and has changed the business location to his home. All equipment will be parked off the street.  Gary Lyon asked if anyone, other than family members living within the home, would be employed in the operation of the business.  Mr. Cook indicated all employees hired will be out in the field and not in the home.  There will be no impact on the homes surrounding his residence.  There were no concerns and Alfred Richens moved to forward a favorable recommendation to Price City Council for the Home Occupied Business - Office Use Only - R & R Yard Service.  Gary Lyon seconded and the motion carried.

 

4.                   CONDITIONAL USE PERMIT SIGN

Nick Tatton appeared before the Commission explaining the need for a more visible sign for the BTAC.  There is a small sign to the far southeast corner, but nothing very informative.  The new sign would be visible from 400 South and Carbon Avenue and meets all code requirements.  Vern Jones informed the Commission this item was on the Price City Council Meeting Agenda last time and was approved, as it is a Price City Building.  It was referred back to Planning and Zoning for approval of the sign regulation.  There were no questions and Gary Lyon moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Sign - Business & Technical Assistance Center.  Larry Bruno seconded and the motion carried. 

 

5.                   CONDITIONAL USE PERMIT

REQUEST TO CONSTRUCT AN ADDITION

TO A NON-CONFORMING DWELLING

Veda Jones was unable to attend this evening and Francis Duzenack made the presentation.  She wants to add a new room addition to her home and they have began work. There were some misunderstandings and the room was added into the front yard setback.  The current dwelling is pre-existing with a 19' setback - and they built out into a 15' setback.  They have now re-arranged their room so they can build it in line with the existing building.  This building is a non-conforming building because of the 19' setback.   The zone in that area has a standard setback of 25', however the entire subdivision was built under a previous ordinance.  She is requesting permission to re-do this room addition and bring it in line with the house.  The code will allow this subject to issuance of a Conditional Use Permit.  There is an 8' jog in the home at the back of the garage and that area will be filled.  It is permitted in the Code to put an addition on a non-conforming use and the front yard setback will not be cut down more than is already there.  Staff has been working on this matter for six months and all concerns have been satisfied.  Larry Bruno moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit For Veda M. Jones for Construction Of An Addition To A Non-Conforming Dwelling at 611 West 300 South in Price.  Penny Sampinos seconded and the motion carried.

 

6.                   CONDITIONAL USE PERMIT

REQUEST TO EXPAND ONTO PROPERTY AT

402 SOUTH CARBON AVENUE & RELOCATION OF IMPOUND YARD

Mr. Basso was unable to attend tonight and Francis Duzenack made the presentation.  Mr. Basso has added RV Campers and Trailers to his inventory. He has leased the property at 402 South Carbon Avenue (Old Mabbutt Station) and will be doing sales from that site.  He has plans for changes, but at this time, it is not certain what that will entail.  He has torn down the remainder of the old motel and has moved the impound yard to the south side of the building.  They are now preparing the site for paving.  There are some changes to be made on the north side also.  One concern is the asphalt paving yet to be done; another is the RV’s on the public right-of-way extending onto the sidewalk and, also the possibility of some parking problems.  Discussion was held and it was determined more information and clarification is needed concerning this matter.   Alfred Richens then moved to table the item until such time as this information is made available to the Commission.  Gary Lyon seconded and the motion carried.

 

7.                   REQUEST FROM KENT BOYACK, PRICE CITY FIRE CHIEF

TO RELOCATE CHAMBER OF COMMERCE SIGN TO

APPROXIMATELY 75 FEET WEST OF THE PRESENT LOCATION

THUS HELPING WITH FIRE DEPARTMENT PARKING

 

Chief Boyack appeared before the Commission to ask that the Chamber of Commerce Marquee Sign be moved just south of the CEU Museum Sign.  The sign now sits in the middle of the firefighters parking lot, causing some inconvenience.  The problem is there are 12 parking spaces available for parking and 24 firefighters.  Joe Piccolo indicated the City has plans to re-design the parking lot so the drainage problem can be addressed.  The elevations of the parking lot may change and perhaps the sign should not be placed until this work is done. The Chamber of Commerce is in agreement with moving the sign.  Their only concern is the power and they will contact an electrician regarding the installation cost.  There were no other concerns and Larry Bruno moved to forward a favorable recommendation for the relocation of the Chamber of Commerce Sign to approximately 75 feet west of its present location.  Joe Piccolo seconded and the motion carried.

Mr. Escoto was not present and it was decided to table the matter.  Gary Lyon made a motion to table the Amazon Family Center.  Laurel Marinos seconded and the motion carried.

 

9.         RE-ZONE REQUEST

JACK LEAUTAUD - BAR A ENTERPRISES

REQUEST TO EXPAND MR-11 ZONE

 

Jack Leautaud approached the Commission saying he was asking for the zone change so they can have better housing in that area.  The price range on the proposed homes will begin at $150,000.00 and go up.  Each lot will be between 11,000 and 12,000 square feet with 19 homes situated on 7 acres. Francis Duzenack explained the zone is currently Rural Residential allowing for one acres lots.  The highlighted area shown on the plan is the proposed expansion on zoning (see copy of plat).  It follows the canal bank down to the City Limit line;  back along Fausett Lane;  following the Commercial Zone out to 300 South, and then going across the Housing Authority Property.  Part of the Housing Authority property is actually in the wrong zone and has been for years.  This will help to get them into the right zoning area.  During the course of discussion, Staff thought it might be better to include the whole area rather than rezone just one small parcel of property.  This would allow us to bring the Housing Authority into the right zone.  Also, there will be a number of people in the area whose lots are currently undersized for the one acre zoning - this will help them and give everybody an opportunity to possibly subdivide their property at some point in time, into smaller than one acre lots. Mr. Leautaud indicated he would be working with a private individual on the sale of the lots.  They will build the houses and sell them on the lots.  The actual uses on the property won’t change much because multi-family dwellings are allowed there now, but only up to a four plex.  The MR-11 Zone allows larger multi-family dwellings.  Aside from that, there is very little difference as the existing properties are protected by the pre-existing uses.  However, tonight’s request is only for the zoning.  There will be a second request for the subdivision.  

 

Dal Hansen, spokesperson for the group, expressed concern regarding multiple dwellings and zone change and feels it will be a big change to allow the larger dwellings.  Most people living there want the one acre lots and single family dwellings to remain.  There are people who are farming and still want to farm.  Francis indicated this use will remain the same - existing properties are protected by pre-existing uses.  They can continue to farm, have livestock and continue on this way forever.    Although the new zoning would allow for larger dwellings, Mr. Hansen would like the new lots subdivided into one acre lots where the buyer would have more square footage.  Commission Member Joe Piccolo mentioned a one acre lot brings the problem of curb, gutter and sidewalk, water, sewer and power lines - a very substantial expense to the property owner when the development begins.  This is one reason they have divided them into quarter acre lots.  These are big lots by Price City standards, but not considered a high density housing project.

 

There were questions concerning traffic on Fausett Lane.  It has become one of the most dangerous roads in Price, both to drivers and pedestrians.  The area around the trailer park is dangerous and there are frequent wrecks. 


When someone is walking down the road, cars cannot pass each other.   Gary Lyon asked if Price City intends on establishing another entry in that area.  Vern Jones indicated 300 South would be a possibility.  Francis Duzenack mentioned plans for the establishment of a 400 South Street between 300 South and Fausett Lane once the development is there.  It was suggested by residents that 400 South Street be developed before the homes are built .  The matter of Fausett Lane traffic, safer main highway access and installation of a traffic light near Wal-Mart was discussed at length.  Mr. Jones indicated one of the solutions to the problem might be to ask the developer of the property to put a cul-de-sac at the bottom of his development.  This would preclude anybody from going on to Fausett Lane. 

 

Several residents expressed concern regarding the sewer problems.  There is an area between two manholes which must be maintained regularly or there is a flooding problem.  They told the Commission there has always been sewer  problems,  but now there is renewed concern,  with the addition of the new Roscrea Apartment Complex, and the new houses yet to come, that this will create additional sewer problems.  Mr. Piccolo indicated there had been no mention of sewer problems before tonight and suggested this be thoroughly researched and contact be made with PRWID.

 

Mr. Piccolo asked if residents could support a project that would provide a 60 foot right-of-way in and out of the area and serve as a secondary route for emergency vehicles and traffic.  Could they accept this new situation rather than to let it continue to as it has in the past, with no curb, gutter or sidewalk or any intention of any of these things being installed.  It stands to reason that if the area still keeps growing and no improvements are made, the problem will only worsen. 

 

Another matter of concern was the water line.  Residents asked if water for the new development would come from their line.  Mr. Piccolo indicated the water for the apartment complex will connect from 300 South to Fausett Lane. Both pressure and circulation problems will be improved by tying the two lines together to make a loop and having the water feed from both lines. 

 

Kendall Branch said thought should be given to the current sewer problem as well as problems with the existing road.  Joe Piccolo told the residents that a study was done by Price City to widen Fausett Lane.  There was some resistance to the idea by the property owners.  Price City will not take a position to condemn property, but will need the participation of the residents.  Fausett Lane has since been paved, but there are no other improvements.  He feels there are some alternatives in the use of cul-de-sacs, limited access and emergency access only.  These types of things can prevent further traffic on Fausett Lane. 

 

One resident asked what problems would be presented when those who farm start up their farm machinery early in the morning or if the new residents do not like living next to farm animals.  Once again, Mr. Piccolo reiterated the pre-existing use condition, saying this is not a large agricultural use area, but just small private farms.  Property owners will have all the rights they now have if the re-zoning change is made.  He also stated there is a chance for the residents to get improvements in the sewer and traffic problems if they will only take advantage of it.   

 

Another question to arise was the type of housing.  Residents stated they deal with the trash from the trailer court and feel it has brought their property value down.  Mr. Piccolo reassured the residents that the lots planned for this subdivision were valuable and comparable homes would be built on the lots.  This will aid in keeping those property values up to where they belong.  As things stand now, there is a good chance of low to moderate income housing being built in the area, but if the zone is changed from RR to MR-11, there will be very nice homes built in the area providing a good property value.  Mr. Leautaud indicated he would be putting mostly single family dwellings beginning at $150,000.00 and up and feels that, at that price, most lots will have nice homes on them. 

 

Mr. Hansen told the Commission he would like to have this issue aborted tonight and asked if the zoning was being changed only to bring someone else into compliance.  Mr. Duzenack indicated this zone change is being done for development only and the reason the property along 300 South was included was because the Housing Authority is outside the zone.  He informed residents the procedure at this point is for the Price City Planning and Zoning Commission to make a recommendation to Price City Council for a public hearing.  The Public Hearing will be scheduled and the hearing process will then proceed in a Price City Council Meeting, where the decision will actually be made.  All residents within the involved area will be advised of the date, time and place of this hearing.


 

Mr. Branch told residents that, if done properly, Mr. Leautaud’s project would enhance everyone’s property values.  He would much rather see a subdivision than another trailer park or multiple family dwellings. 

 

There was no further discussion on this matter and Joe Piccolo made a motion for Staff to prepare the necessary documents for the Public Hearing concerning this issue.  Penny Sampinos seconded and the motion carried.

Vern Jones explained the packet of information regarding zoning.  The Utah Code is your authority to make the decisions.  As different issues come before the Commission, he will supply the needed background information.

Francis Duzenack explained there is a term of office vacancy coming up and if anyone has recommendations, please contact either Vern Jones or Francis Duzenack.

 

Larry Bruno made a motion to adjourn.  There was no further business and the meeting was adjourned at 7:30 P.m.
