III        MINUTES OF MARCH 6, 2006

A favorable motion to approve the minutes of March 6, 2006  was made by Commissioner Lyon. Commissioner Sampinos seconded the motion. Motion Carried.

 

IV        CONDITIONAL USE PERMIT-LOT LINE ADJUSTMENT- FINAL

            255 SO. 200 W. AND 259 SO. 200 W.-MATHIAS AND GEORGINA NOWAK, OWNERS

            Mr. & Mrs. Nowak presented this request. They would like to combine their two parcels to create a larger lot then rearrange the position of their home to fit the new lot. Staff recommends this lot line adjustment as it meets all of the setbacks and will actually improve the lot. A favorable recommendation for a Conditional Use Permit Lot Line Adjustment was made by Commissioner Shook. Commissioner Lyon seconded the motion. Motion carried.

 

V         CONDITIONAL USE PERMIT-BUSINESS AND SIGN-FINAL

            17 EAST MAIN STREET-THE COFFEE SHOP-DUANE AND TAMMY SHERMAN, OWNERS

            Mr. and Mrs. Sherman presented this request. The Sherman’s are purchasing the previously owned business of Becky’s Brews. The sign name and everything regarding the building will stay the same. This is just an ownership change. Staff recommends approval with a walk through inspection by the Building Inspector. A favorable recommendation for a Conditional Use Permit Business and Sign Final was made by Commissioner Richens contingent on a walk through building inspection. Commissioner Shook seconded the motion. Motion carried.

 

VI        CONDITIONAL USE PERMIT-BUSINESS AND SIGN-FINAL

            1179 EAST MAIN-THE UPS STORE-DANIEL AND TERRI ALLRED, OWNERS

            Mr. & Mrs. Allred presented this request. This is an ownership change for the current UPS Store located at 1179 East Main in Price. There are no sign changes or changes to the building. Staff recommends a walk through building inspection. A favorable recommendation for a Conditional Use Permit Business and Sign contingent on a walk through building inspection was made by Commissioner Sampinos. Commissioner Sacco seconded the motion. Motion carried.

 

 

 

 

VII      CONDITIONAL USE PERMIT-BUSINESS AND SIGN FINAL

            9 E. MAIN STREET-LEE NAILS-KYLE TRUNG PHAM, REPRESENTATIVE

            Kyle Trung Pham presented this request. Lee Nails is an existing business moving from Carbon Ave. to 9 E. Main Street. The existing sign on the building will be replaced with a plastic banner making the sign just a copy change. Staff recommends a walk through building inspection. A favorable recommendation for a Conditional Use Permit Business and Sign Final contingent on the building inspection was made by Commissioner Lyon. Commissioner Richens seconded the motion. Motion carried.

 

VIII     CONDITIONAL USE PERMIT-BUSINESS AND SIGN FINAL

            78 N. CARBON AVE.-ROCKLAND MUSIC-TODD OLDHAM, OWNER

Todd Oldham presented this request. This business will be a retail store selling musical instruments of all types. The building also has 4 or 5 rooms to offer for individual music lesson space in the future. This business is an independent name not a franchise. Staff recommends approval and will do building inspections as necessary during remodeling. There are three signs on the building, one on the North side to view from 1st north, one on the building on Carbon Ave. and one on the back of the building. A favorable recommendation for a Conditional Use Permit Business and Sign was made by Commissioner Richens. Commissioner Sampinos seconded the motion. Motion carried.

 

IX        CONDITIONAL USE PERMIT-PRELIMINARY AND FINAL

            ELKRIDGE PLANNED UNIT DEVELOPMENT-PHASE III-400 W. 800 SO. (APPROX)

            CASA BELLA ENTERPRISES-T.H. AND LINDA POLONI, OWNERS

            T.H. Poloni presented this request. Phase III has 3 lots to build homes and 1 lot used for R.V./trailer parking.  The road is 6” of gravel now and as each phase is completed the road will be asphalted. The sewer and water are completed for this phase. The road will be kept by the Association and not dedicated to the City. The R.V./trailer parking in the corner section will resolve storage problems for the Association.  The site has dedicated slots for each homeowner. The development began with 54 lots in the subdivision, there are only twenty lots now which leaves plenty of R.V. parking for each homeowner. The irrigation ditch on the south side is ready to be piped now and T.H. will begin the process. A favorable recommendation for a Conditional Use Permit Preliminary and Final for the Elkridge PUD Phase III was made by Commissioner Nielson. Commissioner Lyon seconded the motion. Motion carried.

 

X         CONDITIONAL USE PERMIT-PRELIMINARY AND FINAL

            KROMPEL SUBDIVISION PHASE II-SAGEWOOD ROAD AND PARKWAY

RICK KROMPEL, OWNER

Rick Krompel presented this request. Phase II has 11 lots. The Cottonwood Village right of way issue has been resolved. The plans show the actual property line is right on the fence line. There will be 33’-6” feet of asphalt for a short distance widening to 35’. This will create an offset of 8’to meet the existing sidewalk on the south side of the parkway. There will still be a 60’ right of way to line up the new sidewalk to existing sidewalk. The road is slightly narrower than required, traffic will get through as expected. Curb and gutter will come right into place and be a nice addition. The Cottonwood Village driveway will not have access to parkway as this will remain a private drive. Staff had an item come up today with the City Engineer, Gary Sonntag. The engineering department has not had enough time to completely and accurately review the Phase II plans and does not want a final granted until that can be done. Therefore, staff recommends Phase II for preliminary until engineering approval comes through. A 10’ easement needs to be added to the front of each property. Grading of the project can be started for site preparation. A favorable recommendation for a Conditional Use Permit Preliminary with approval for rough grading site preparation was made by Commissioner Lyon. Commissioner Shook seconded the motion. Motion carried.

 

XI        STAFF-  REVIEW OF HOME OCCUPIED BUSINESS

            CASTLE COUNTRY FENCING-STEVE MANZANARES

            Steve Manzanares, owner of Castle Country Fencing has taken his business beyond the Home Occupied Business requirements and is in violation of his permit which is Office Use Only; due to the inventory, equipment and vehicles stored on the property. Mr. Manzanares has purchased property at First North on the West side of Krompel’s Carwash for storage and a future building for his business but has not turned in a CUP for the property at this time. Mr. Manzanares has been contacted several times in relation to this problem and has not yet complied. Due to neighborhood and police inquiries regarding the parking and inventory problem, it has been brought before the Planning and Zoning Commission. Staff recommends a letter to Mr. Manzanares with a 30 day time allowance for the removal of all items that are not in compliance with a HOB. If Mr. Manzanares does not comply with the requirements, the item will be passed to the City Council for the possible revocation of Castle Country Fencing Conditional Use Permit and possible citations. The letter should come from the Planning Commission Chairman and be drawn up by tomorrow, March 21st. A Motion was made by Commissioner Lyon to have a letter drafted with a deadline date of April 5, 2006 to comply with the regulations of a Home Occupied Business. The items dealing with Castle Country Fencing including business vehicles, equipment and inventory are to be removed from the Manzanares property. If the items are not removed by the said date, the City Council and City Attorney will be informed of the conditions for possible license revocation. Commissioner Shook seconded the motion. Motion Carried.

           

            Sexually Oriented Businesses-

Commissioner Shook has met with City Attorney, Nick Sampinos regarding the Sexually Oriented Business ordinance. The ordinance is being drafted and will hopefully be ready for the next Planning and Zoning meeting for recommendations to the City Council by April 10th. Commissioner Shook will then present the item to the City Council on April 12th. Commissioner Nielson has met with the Mayor and City Council to update them on this upcoming agenda item.

 

            There were no further items on the agenda and Commissioner Lyon moved to adjourn. The meeting adjourned at  6:46 P.M.
