Present: John Angotti (Chairman), Francis Duzenack (Zoning Administrator), Larry Bruno (Vice-Chairman), Carolyn Vogrinec (Secretary), Laurel Marinos, Penny Sampinos, Gary Lyon, Alfred Richens, Joe Piccolo

Meeting convened at 6:00 P.M.


I. MINUTES OF MARCH 8, 1999

Penny Sampinos called attention to Item #IV, Paragraph 1, Line 1- Home Occupied Business for Handyman Service - James Horvath. Mr. Horvath's name is misspelled and the line will be corrected to read "Mr. Horvath indicated he would be doing handyman work only and has no plans for a sign." There were no other changes and Penny Sampinos made a motion to approve the minutes of the March 8, 1999 Meeting as corrected. Gary Lyon seconded and the motion carried.


II. HOME OCCUPIED BUSINESS - OFFICE USE ONLY

FRIENDLY FIRE PAINT BALL AND SPORTS LLC
959 NORTH 100 EAST - TED MAGLEBY

Mr. Magleby explained the nature of his business and indicated game sites are located throughout the remote areas of Carbon and Emery County. His home will be used as an office only and the trailer on his driveway will be used to store the paint ball equipment. The trailer is then hauled to the paint ball game location where equipment is either sold or rented. The stored material consists of paint guns, CO2, protective equipment and paint which is biodegradable and water soluble. Francis Duzenack indicated that Mr. Magleby already has a license for his PharmaTech Business, but would quality for two business licenses under one location, with the second license at no fee.

He will check further on this. Mr. Magleby indicated he would like to have two separate business licenses. There were no further questions or concerns and Larry Bruno moved to forward a favorable recommendation to Price City Council for the Home Occupied Business - Office Use Only for Friendly Fire Paint Ball and Sports LLC. Joe Piccolo seconded and the motion carried.


III. CONDITIONAL USE PERMIT - OTG WELDING REQUEST TO SELL PLANT STANDS

Ms. Peters told the Commission that Mr. Pierce had given her verbal permission to use the above property and once the permit is approved, will follow with written permission. She will sell decorative wrought iron products for plants and gardens. She plans to use a portable sign for advertisement and will sell from March 25 through May 31, 1999. Francis Duzenack indicated this situation is similar to past solicitors at that location. Ms. Peters has a Carbon County Business License which is reciprocal with Price City. There were no concerns and Gary Lyon moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit for the request of OTG Welding allowing them to sell decorative wrought iron items at approximately 950 East Main, contingent upon receipt, by the Price City Zoning Administrator, of a written letter of consent from the property owner, Ellis Pierce. Laurel Marinos seconded and the motion carried.


IV. CONDITIONAL USE PERMIT - BUSINESS AND SIGN

A TOUCH OF APPEARANCE AUTO DETAILING
264 SOUTH CARBON AVENUE - ERNEST HERRERA

Mr. Herrera explained he and his son will do auto detailing at the above address or at the customer's home. He has a Carbon County Business License allowing him to do business at either place.

All products used in his work are biodegradable. They would, at some future time, also like to expand their business to include the sale of auto accessories. Gary Lyon asked concerning the business sign, but Mr. Herrera had not yet made a choice of signs and is uncertain of size and placement. There was some discussion on this matter. Mr. Herrera will discuss the sign with Mr. Duzenack and return to Planning and Zoning with a sketch, requesting approval once all details have been finalized. Plans were provided showing sufficient parking for the business. Customers will be assigned an appointment time so traffic will not build up in the parking area.

Mr. Herrera has submitted his P.R.W.I.D. Industrial Wastewater Survey, but has not yet heard from them. Mr. Duzenack suggested including a P.R.W.I.D. approval in the minutes as they will have a concern with pre-treatment requirements for washing cars and using chemicals going into their sewer. There will be no alterations to the building, however, the building has been vacant for some time and Mr. Duzenack recommended that both he and the Price City Fire Chief do a building inspection prior to occupancy.

Joe Piccolo asked concerning the Carbon County Business License. Mr. Herrera indicated he has a part-time Carbon County Business License because he will still be doing his regular job until they determine the success of this new venture. Francis Duzenack indicated the business license should be issued in the principal place of business. Mr. Piccolo suggested that since the business has been issued by the County, the next time it is renewed, it should be done through Price City.

There was no further discussion and Larry Bruno moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit for A Touch of Appearance - Business Only, contingent upon approval of Price River Water Improvement District and inspection of the building by the Price City Fire Chief and Building Official prior to occupancy. Penny Sampinos seconded and the motion carried.


V. CONDITIONAL USE PERMIT - SIGN

MARKET EXPRESS CHEVRON - CAR WASH - 121 NORTH CARBONVILLE ROAD
SINGLE POLE SIGN WITH READER BOARD - ANGELO AND DINO KIAHTIPES

Angelo Kiahtipes told the Commission they would like to have a single pole sign for the car wash only. Their car wash is so far away from the store, they feel they need to have a sign. Joe Piccolo asked concerning the distance of the two present free standing signs. Mr. Kiahtipes indicated they were approximately 150 to 160 feet apart. The business is in an S3 Zone and requires a 300 foot separation for advertising the same business. Free standing signs close together present a problem, but, there is no problem with signs on the building. If a sign is attached to the car wash building, there is no problem, however, a pole sign will be in violation. Larry Bruno indicated that another sign would make a third sign and the Price City Land Use Management and Development Code allows only two free standing signs. Following a lengthy discussion on the matter, it was determined by the Commission that there is a conflict in the way in which the Price City Land Use Management and Development Sign Code is written that could warrant review or change.

Gary Lyon then made a motion to table this item for further consideration for a period of 30 days, in order to allow the Commission to examine the Price City Land Use Management and Development Code and make appropriate changes for review by the Price City Attorney. Joe Piccolo seconded the motion, with the amendment that the Commission then review these changes and provide a solution to this problem within 30 days time. Motion carried.


VI. CONDITIONAL USE PERMIT - BUSINESS AND SIGN

CAMPBELL FINANCIAL GROUP, INC. - 70 WEST MAIN
FINANCIAL SERVICES OFFICE - JEFFREY C. CAMPBELL, PRESIDENT

Penny Sampinos, as a representative of the Assumption Greek Orthodox Church, the owner of the building being leased by Mr. Campbell, indicated she would participate in the discussion, but abstain from voting, due to a conflict of interest regarding this item.

Mr. Campbell appeared before the Commission to explain the nature of his business. He is leasing the entire lower level of the building. The building owner will remodel to specification and those plans have been filed with the Price City Building Department. Mr. Campbell presented a diagram of his sign - a 1' x 3' window sign. Larry Bruno asked concerning the available parking and discussion was opened on the matter. Ms. Sampinos told the Commission that she is not certain whether or not there are parking facilities behind the building. Francis Duzenack indicated there are public lots on Carbon Avenue as well as in back of the buildings on the south side of Main Street. He suggested Mr. Campbell advise his employees to use those parking lots so Main Street parking can be utilized by the public. He also suggested checking with Far West Bank to see if there are any parking arrangements already in place. There were no other concerns and Alfred Richens moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Business and Sign for Campbell Financial Group, Inc. Gary Lyon seconded and the motion carried.


VII. CONDITIONAL USE PERMIT - CONCEPT SAGEWOOD SUBDIVISION

Because Mr. Krompel was not in attendance and the Commission felt there was not enough detailed information to proceed, it was decided to table this item. Alfred Richens moved to table the matter until Mr. Krompel is able to appear. Gary Lyon seconded and the motion carried.


VIII. INFORMATION ONLY - MILKY WAY PROJECT

Mr. Anast was unable to attend and asked that he be removed from the agenda.


IX. STAFF

A) Kentucky Fried Chicken brought in plans for their new project and will be on the next agenda. The plans are in the office if anyone would like to review them.
