III           MINUTES OF APRIL 23, 2007

A favorable motion to approve the minutes of April 23, 2007 as read was made by Commissioner Lyon. Commissioner Richens seconded the motion. Motion carried.

 

IV           HOME OCCUPIED PERMIT- BUSINESS – FINAL

865 NORTH EASTWOOD DRIVE – STEELE’S LANDSCAPING -TOM AND ROBYN STEELE, OWNERS

Tom Steele presented this item for a 6-month per year request. Home Occupied office use only permit at his home located at 865 North Eastwood Drive. Mr. Steele will have a landscaping business that will include a trailer with lawnmowers, hedge trimmers, aerators and other such yard tools. The trailer will be attached to a truck which will be parked in front of his residence. Mr. Steele has been operating this business without a license for some time and has not noticed an impact on the neighborhood or received complaints. Parking in the driveway has not been an option as it is on a downhill slope which would make it almost impossible to park a trailer. Mr. Steele has two personal other vehicles located in the driveway. Staff recommends approval with limitations of only one truck and trailer parked in the street at any time during the spring and summer months. There are to be no vehicles parked in the street during the winter season. A review of this business will be done next spring if complaints are received by Price City. MOTION. A favorable motion was made by Commissioner Nielson to approve the Home Occupied Office Use Only permit with the contingencies of a review in one year and the parking of one truck and trailer in the street at all times with a permanent off street parking arrangement for the truck and trailer to be finalized by the 1 year review. Motion seconded by Commissioner Sampinos and carried.

 

V             HOME OCCUPIED PERMIT- BUSINESS- OFFICE USE ONLY-FINAL

                686 NORTH 100 EAST- MJ’S BULLHIDE-MAX JONES, OWNER

Max Jones presented this request for a Home Occupied (HOB) permit for Office Use Only at his home located at 686 North 100 East. This business will consist of a van for supplies that will be parked in the back yard of the home. The vehicle will travel to the jobsite with a portable spray liner machine that can be used for trucks, trailers, contained units, porches etc. There will not be an impact to the neighborhood or to the environment with this business. Precautions will be taken for all customers with a containment area to prevent overspray. This business will most likely be only operated during the warm weather season as the materials need to be 53 degrees for above to dry properly. A list of chemicals that will be used requiring an MSDS sheet will be turned into the Price City Fire Chief. Staff recommends this business for approval with the following contingencies:

·         No permitted employee, current or future, staging or gathering at the home, all employee activity must remain at individual job sites;

·         No on street parking of business related vehicles including but not limited to cars, trucks, trailers, vans or other related vehicles;

·         No storage of any inventory or equipment beyond that capable of being maintained within the confines or work trucks and work trailers, all work trucks, trailers etc. must remain locked at the HOB address

·         Required administrative approval of any future signage placed on the property to ensure compliance with sign code

MOTION. A favorable motion was made by Commissioner Nielson to approve the Home Occupied Office Use Only permit with stated contingencies. Motion seconded by Commissioner Shook and carried.

 

VI           CONDITIONAL USE PERMIT- SUBDIVISION- FINAL

                1762 E. 500 S. -JARED AND PAIGE HADDOCK, OWNERS

Paige Haddock presented this request to subdivide of a piece of property owned by the Haddocks in east Price and sell the lot for the building of a home. Mrs. Haddock provided the Commission with a final plat indicating all of the legal descriptions, utility easements and utility connectivity for the property. Final approval should include the development improvements for the street. Staff recommends final approval. MOTION. A favorable motion was made by Commissioner Richens to approve the Conditional Use Permit Final. Motion seconded by Commissioner Lyon and carried.

 

VII          CONDITIONAL USE PERMIT- PLANNED UNIT DEVELOPMENT- FINAL

                431 AND 435 EAST 100 NORTH – GARRY FARRELL, OWNER

Tracy Udink presented this final approval for a Planned Unit Development (PUD) at 431 and 435 East 100 North. Fire Chief Bedont will require a 6’ minimum setback on the west property boundary between the properties for minimum clearance. Chief Bedont is uncomfortable with the 6’ setback as it would be dangerous to send firefighters through such a small confined area and requests the 6’ setback area kept clear of debris and storage at all times as a condition of approval. Tracy stated that the exterior backside of the homes will be stucco and no combustibles will be in other buildings such as sheds. Chief Bedont commented that homes burn from the inside out and the exterior finish is not the concern. The Commissioners asked whether or not all of the adjoining neighbors had been contacted as to the new additions that will be built behind their homes. Mrs. Udink stated that the next door neighbor Mrs. Llewylyn has been contacted with no concerns.  She has assured the Commission that the stipulated landscaping requirement of 5% will be met with both homes and throughout the PUD. The existing home of Garry Farrell will be sold.  Mrs. Udink stated that the utility hookups from a home previously in that location were capped.   Rear entrances will be left for emergency vehicles and the area will be cleaned of old trees, debris and brush.  The Commission wants to make sure that there is room for a sidewalk in the 6’ setback area and that no utilities will be adversely affected by this addition. The Commission is also requesting letters of approval from three of the adjoining property owners so they understand how they will each be affected. Additional Information Requested by the Planning and Zoning Commissioner (1) all prior requests and contingencies required at preliminary approval (2) statement that homes will meet HUD requirements (3) actual professionally prepared site plan showing individual utility connection to each home in the residential only PUD and all required setbacks and landscaping (4) actual new test hole soil report. MOTION. A motion to table this item until the next meeting for the additional information requirements and neighbor approvals in writing was made by Commissioner Lyon. Motion seconded by Commissioner Shook and carried.

 

VIII        CONDITIONAL USE PERMIT- WAREHOUSE BUILDING-FINAL

                425 EAST AIRPORT ROAD- MASONRY MASTERS, INC. – DIXON MORLEY, OWNER

Dixon Morley presented this request for a name change as Conditional Use Permits are non-transferable. The building will be sold to Sign Edge. MOTION. A favorable motion was made by Commissioner Nielson for a Conditional Use Permit name change. Motion seconded by Commissioner Sampinos and carried.

 

IX           CONDITIONAL USE PERMIT – AMENDMENT- FINAL

                1410 EAST AIRPORT ROAD – MASONRY MASTERS, INC. – DIXON MORLEY, OWNER

MOTION. A motion to strike Item IX as requested by Dixon Morley was made by Commissioner Shook. Motion seconded by Commissioner Lyon and carried.

 

X             CONDITIONAL USE PERMIT REVIEW/ACTION:  AUTO ALLEY

Fred Jones, owner of Auto Alley was not present for this review. Darren Brown was in attendance and stated that he will be purchasing the business from Fred Jones in the next few months. Mr. Brown understands that before he purchases the business, there are unresolved issues with the current owner. He is requesting an extension of the previous Conditional Use Permit conditions and requirements in order to have time to evaluate the situation and take care of the outstanding issues. Mr. Brown will need to return to Planning and Zoning with a new request and application for a Conditional Use Permit (CUP) as they are non-transferable. A list of contingencies from the August 2006 Planning and Zoning meeting were given to Mr. Brown.  Staff recommends the Commission establish new stipulations for Mr. Brown as Mr. Jones may no longer be involved. An extension to July 1, 2007 will be given to Mr. Jones at Mr. Brown’s request. Mr. Brown needs to return to Price City by the middle of June, 2007 to begin the application process. Failure to comply with the CUP may result in revocation of the permit. MOTION. A favorable motion was made by Commissioner Lyon for an extension to the property and business issues to July 1, 2007 and for Mr. Brown and or Mr. Jones to return to Planning and Zoning for the July 23rd meeting with a new CUP. Motion seconded by Commissioner Richens and carried.

 

XI           OTHER BUSINESS-

               

·         Update- Mike Giannini reviewed with the Commission his future plans for a Home Occupied Business in the Haddock subdivision. He will be on the next agenda for permit approval as he did not make the cut off date for application.

 

·         Update- American Dream Subdivision Update- This will come before the commission at the next meeting asking for Preliminary approval on the entire subdivision and a Final on Phase I. This will be a 221 residential subdivision with 4 commercial lots.

 

·         Update- Jeff Nielson reviewed his subdivision in the Cove Basin area with the Commission and will return for Concept approval at the next meeting as he did not make the cut off date for application.
