III        MINUTES OF APRIL 24, 2006

A favorable motion to approve the minutes of April 24, 2006 as read was made by Commissioner Lyon. Commissioner Sampinos seconded the motion. Motion Carried.

 

IV        HOME OCCUPIED BUSINESS -FINAL-OFFICE USE ONLY-INTERNET BUSINESS

            695 W. 300 SO. - PRICE BIZ ADS.COM-JEFF SANDOVAL, OWNER

            Jeff Sandoval presented this request. Mr. Sandoval has done quite a bit of research for a website that advertises the businesses and events in Price City. The website he has designed will be strictly for Price City businesses, education and Price City emergency services. The website is very user friendly with giveaways, event calendars and classifieds, creating basically a community website. Advertising can be done by contacting the Sandoval’s by phone so there will not be any traffic or impact to the neighborhood. Staff recommends approval for this internet business without concerns. A favorable recommendation for a Home Occupied Business Final was made by Commissioner Richens. Commissioner Richens seconded the motion. Motion carried.

 

V         HOME OCCUPIED BUSINESS AND SIGN- OFFICE USE ONLY -FINAL

            239 N. 400 W.-STONE TOAD WATERSCAPES-LYLE BAUER

Lyle Bauer presented this request. Mr. Bauer will be building ponds, waterfalls and some landscaping associated with waterfalls. This will not be a yard maintenance business, it will only specialize in decorative water/yard projects. Most supplies will be delivered to the building site and/or owners homes so as not to have an impact on traffic in the neighborhood. There will not be any stock or inventory stored at the home. If temporary workers are hired, it will be through SOS and will meet at the job site or wherever SOS allows them to congregate. This is mostly a seasonal business as weather allows.  Mr. Bauer has applied through DOPL for his landscape contractor’s license which should be here in 2-3 days at which point he can apply for his business license. A sign will be placed on the mailbox and kept under the 150 sq. inch size regulations. Building permits are not required for this type of landscaping as only plug in units for water and electricity are usually used. If an electrician is required, one should be contacted as a landscaping license does not allow for electrical work. Staff recommends this business upon receiving the landscaping license. A favorable recommendation was made by Commissioner Richens for this Conditional Use Permit Commission Nielson seconded the motion. Motion carried.

 

 

 

VI        CONDITIONAL USE PERMIT-BUSINESS AND SIGN FINAL

            894 E. 100 N.-SILKY SMOOTH-DANIELLE PENDERGRASS, OWNER

Danielle Pendergrass presented this request. This business is a change of ownership from Gina Sacco the previous owner. It is a laser hair removal business that has been in business for approximately 2 years. Mrs. Pendergrass is trained and certified with 1 ˝ years of experience working with Mrs. Sacco. She currently holds all licensing necessary as well as liability insurance. Staff recommends this business and sign as presented. A favorable recommendation was made by Commissioner Sampinos for this Conditional Use Permit Business and Sign Final. Commission Shook seconded the motion. Motion carried.

 

VII      CONDITIONAL USE PERMIT-NEW BUILDING-CONCEPT ONLY

107 SOUTH 100 EAST MAIN-PROFESSIONAL TITLE SERVICES-CLAY AND CORNELIA HOLBROOK, OWNERS

Clay Holbrook presented this request. Mr. Holbrook will build a new office building for his title business at (107 South 100 East). The current home on the property will be torn down after an asbestos test has been done in approximately six weeks. This will be an added improvement to the area with a new 2700’ office building, 10% new landscaping and 10 parking spaces. The sign has not yet been decided as to the design or where it will be placed on the building. All of the preliminary and final decisions will be made in the next few weeks to meet the starting date of 2-3 months. Staff recommends approval. A favorable recommendation was made by Commissioner Lyon for this Conditional Use Permit Concept Only. Commissioner Sacco seconded the motion. Motion carried.

 

VIII     CONDITIONAL USE PERMIT-BUSINESS AND SIGN-FINAL

            391 N. 400 E. - PRICE PEDIATRIC DENTISTRY-TRACE LUND, PEDIATRIC DENTIST

Jon Anast presented this request on behalf of the Price Pediatric Dentistry group. The entire building will be used and shared with other dentists. The dentists are currently working in Price City and would like to have their own facility. The inside of the building will be remodeled to fit their needs and only the removal of outside neon signs will be necessary for the exterior of the building. The original building specs for the use of the building was for office space if the restaurant did not continue. Staff recommends this business into the neighborhood with adequate parking. The signs will just be copy changes. A professional office building is allowed in a residential zone with a Conditional Use Permit.  A favorable recommendation was made for this Conditional Use Permit Business and Sign Final by Commissioner Shook. Commissioner Sampinos seconded the motion. Motion carried.

 

IX        CONDITIONAL USE PERMIT-BUILDING (AND GRANARY) RENOVATION-FINAL

            68 SOUTH 100 EAST- SUE CHRISTENSEN, BRYNER HOUSE MUSEUM DIRECTOR

Sue Christensen presented this request. Mrs. Christensen would like to take the 150-year old Bryner home (oldest brick home in Price) and create a museum in Price. The museum would have rooms filled with antiques, stories and photos of previous tenants and be set up as a working museum for those who visit.  The museum would give visitors hands on experience in the art of making butter, candles, bread and the chance to visit a Blacksmith shop. Visitors will have the opportunity to sew a section of a quilt and then the quilt will be displayed for raffle at all times to raise revenue for the museum. A garden will be available for children to help plant and then watch it grow each time they visit. So many people have lived in the home and influenced its existence; it will be beautiful again soon. The Bryner family is involved in the home’s restoration with the donation of antiques and original furniture. The home will be turned over as a 501C3 private non-profit entity to open as a museum. Mrs. Christensen would like to have the bottom half of the home displayed as the 1890’s and the top half representative of the 1920’s and possibly add an automobile of the era to add to the museum. She is currently looking for donations and ways to raise money for the project and has assistance from the Daughters of Utah group and the Historical Society. The original electric chandeliers are still in place as well as most of the window glass. A special UV coating can be put on the top of the glass to keep the sun from damaging the antiques.  Bryan Wing will restore the home to its original beauty with O’brien Plumbing working on the inside plumbing and Utah Power & Light donating the electrical work. A new roof will be put on soon by Hansen Roofing of Spring Glen. Lead paint may be a concern and will be looked into for the safety of future visitors. Mayor Piccolo told Mrs. Christensen that he would match the USDA funding of $100,000 if she was able to get USDA to help fund this project. The future maintenance will be done by raising money from the gift shop proceeds, reservations and the selling of books and videos. It will be added to the historical registry to gain visitors to the area. Price City as agreed to add signs throughout town for directions and advertising. Staff recommends the Bryner Museum and feels it will be a great asset to the community. The bathrooms do not have to be ADA as long as there are available restrooms in the vicinity per Active Re-Entry of Price. An elevator does not have to be installed but, if enough money is available, an elevator will be installed.  A favorable recommendation was made for this Conditional Use Permit Final by Commissioner Lyon. Commissioner Nielson seconded the motion. Motion carried

 

X         CONDITIONAL USE PERMIT-SUBDIVISION-CONCEPT ONLY

            690 WEST PRICE RIVER DRIVE- CREEKVIEW SHOPPING CENTER-

MILES LEBARON, MANAGING MEMBER.

Francis Duzenack presented this request. This project for Creekview Shopping Center is to change ownership status to condominiums in order for each building to be surveyed separately with all of parking becoming common area; each parcel can then be sold to individual owners. The Oil Express and Big O Tire stores would each like to purchase extra property for possible future building additions. Some of the buildings will need minor changes with firewall protection between each parcel to separate. Sidewalks should have been finished when the project was first built, they are now necessary in order to complete this condominium change. There will be no additional buildings added to the center per the concept plat; only separate surveys for each parcel. Staff recommends this project with the sidewalk additions as pedestrian traffic is quite a bit busier now and sidewalks are needed. The sidewalk development agreement must be signed before a final can be issued. A financial agreement can be completed and property sold with tenants as long as the property owners have signed the development agreement. A favorable recommendation was made by Commissioner Shook for this Conditional Use Permit Concept Only, contingent upon the signing of a development agreement to complete the sidewalks around the shopping center. Commissioner Lyon seconded the motion. Motion carried.

 

XI        CONDITIONAL USE PERMIT-BUSINESS-FINAL

            45 SO. 100 W.-BOOKCLIFF SALES REPAIR SHOP-RICK SHINER, OWNER

Rick Shiner presented this request. Bookcliff Sales would like to use the back 2/3 of the building to add a repair shop for small jobs such as air starters. The electrical system and bathrooms have been upgraded and cleaned up. The repair shop will not be open to the public from 100 West only from the main entrance on Carbon Ave.  PRWID has checked the drain and given approval as there will not be any cleaning solvents used. Staff recommends this project as it will give Bookcliff Sales more room to work. Mr. Shiner is in contact with Nick Sampinos regarding the railroad right of way that hasn’t yet been cleared over to the property owners even though the railroad track has been removed.

A favorable recommendation was made for this Conditional Use Permit Business Final by Commissioner Richens. Commissioner Nielson seconded the motion. Motion carried

 

XII      STAFF-PLANNING COMMISSIONERS JOURNAL HANDOUT-“CENTER PLACES”

 

            Updates:

            Mad Man Basso R.V. lot is in the process of asphalting the parking lot per requirements.

 

            Castle Country Fencing has been given more time to clean up his property with permission from Police Chief Aleck Shilaos.

                                   

            There were no further items on the agenda and Commissioner Lyon moved to adjourn. The meeting adjourned at 7:05 P.M.
