MINUTES OF MAY 10, 2004

I           PLEDGE OF ALLEGIANCE

            The Pledge of Allegiance was led by Chairman John B. Angotti.

 

II         ROLL CALL

            The above members were in attendance and a quorum present

 

III        MINUTES OF APRIL 26, 2004

            There were no changes or corrections and Gary Lyon moved to forward approve the    Minutes of April 26, 2004, as read.  Penny Sampinos seconded and the motion carried.

 

IV        HOME OCCUPIED BUSINESS – OFFICE USE ONLY

            K-N-K LANDSCAPING – 419 EAST 200 NORTH

            KENT JONES, OWNER

            Mr. Jones explained he will be using his home only for the office part of the business and            no employees or customers would be going to the home.  Presently he has no employees             but would possibly hire some if the business goes well.  Mr. Jones, as well as any     employees would be working at the job site and not from the home, which will be for        office use only.  Larry Bruno moved to forward a favorable recommendation to Price City         Council for K-N-K Landscaping. Jeanne McEvoy seconded and the motion carried.

 

V         CONDITIONAL USE PERMIT – DAYCARE

            BLUEBIRD DAYCARE – 315 SOUTH 500 EAST

            CLORINDA CORDOVA, OWNER

            Ms. Cordova stated Utah State is processing her application and is awaiting approval for a        business license from Price City before they continue.  She will submit a copy of the State           license when it is received.  There was a question concerning the fence.  Ms. Cordova    stated the back yard is fenced in and they will use only the back yard to play in.  She has       no intention of using a sign, but if she decides to, she will stay within the 150 square        inches allowed by Code.  She is licensed to care for 8 children per employee and she is     employing 1 assistant in the business.  Gary Lyon moved to forward a favorable   recommendation for this Conditional Use Permit, Daycare.  Frankie Sacco seconded and             the motion carried.

VI        CONDITIONAL USE PERMIT – BUSINESS AND SIGN

            THE SILVER AND GIFT SHOP

            26 EAST MAIN

            BILL BRADSHAW, OWNER        

            Mr. Bradshaw explained the store will carry Native American jewelry as well as unique             gifts.  The sign mounted on the building is shaped like a stop sign and is 47” X 47”.  Other        signs will be in the windows of the store.  It was also explained the store will only be open   three days a week, Thursday, Friday, and Saturday.  Penny Sampinos moved to forward a      favorable recommendation for this business and sign.  Alfred Richens seconded and the             motion carried.

 

VII      CONDITIONAL USE PERMIT – BUSINESS

            HOT PEPPER TACO EXPRESS – MOBILE RESTAURANT

            SMITH’S  AND FEATURE FILMS FOR FAMILIES PARKING LOTS

            CARMEN ESCOTO, OWNER

            It was explained the Escoto’s have a trailer with grills and an independent water system that they would like to park at various locations and sell tacos from.  A letter was presented             from Feature Films for Families granting permission to park the cart in their parking lot.  It    was stated they are also awaiting a letter from Smith’s Food King for permission to use       their lot and they plan to have a booth for International Days.  The Commission explained          that every location would need to be approved. Jeanne McEvoy suggested parking the cart            at the Culture Connection activities at 100 East and Main.  Larry Bruno moved to forward             a favorable recommendation to locate this mobile business in the parking lots of Feature Films for Families and Smith’s Food King, contingent upon a letter of approval from the             Health Department.  Gary Lyon seconded and the motion carried.

 

VIII     CONDITIONAL USE PERMIT – RELOCATION

            MOVE SNOWIE SHACK TO 59 EAST 100 NORTH

            JERRY CARLSON, OWNER

            This item was discussed under “Staff” at the April 26, 2004 Commission meeting.  There was some       concern about having the Snowie Shack in such a high traffic area.  It was stated there had          been no problems so far.  Gary Lyon moved to approve the application for a 60 day permit       in order to evaluate the impact on traffic.  Alfred Richens seconded and the motion carried.

           

IX        STAFF

 

            A         DR. DALE TERRY – RESIDENTIAL ZONING ISSUES

                        Dr. Terry had been approached by City Officials concerning zoning violations on                                   his residential property.  He explained he stores one classic car in each of the 6                               temporary storage containers because he cannot get them across his driveway.

                        (Dr. Dale Terry – Residential Zoning Issues, Continued)

            He stated the driveway is in such poor condition due to construction of Cedar Hills                    Drive by Price City four years ago.  He asked to be granted a temporary use permit to use the storage containers until Price City repairs the driveway.  As the two issues are separate,         the Commission suggested other options.  One option was to rezone the property as       commercial in order to allow a garage large enough to store all the vehicles. Another was           to do a single lot subdivision in order to zone one portion of the lot as commercial to avoid         paying higher taxes.  There was a question concerning the cement trucks on the property.              Dr. Terry said they are being worked on by the College of Eastern Utah and were being     stored on the lot on a temporary basis.  There was much discussion and it was decided Dr. Terry should attend the City Council meeting and discuss the driveway with       Mayor and Council.  It was also explained if he wanted to get a temporary use permit for   the        storage containers, he   would have to return to the Planning Commission with a formal         application.  He said he would approach the City Council at their May 12,         2004 meeting             during the “public comments” section of the meeting.

 

 

There was no further business and Gary Lyon moved to adjourn.  The meeting adjourned at 7:17 PM.
