I. MINUTES OF MAY 10, 1999

There were no additions or corrections and Gary Lyon made a motion to approve the minutes of May 10, 1999 as read. Larry Bruno seconded and the motion carried.


II. HOME OCCUPIED BUSINESS - CLASSY VARIETY NAILS

LESA BURGE - 581 SOUTH ROSE AVENUE
ARTIFICIAL NAIL SHOP - ALL SIGNATURES SUBMITTED

Ms. Burge appeared before the Commission to explain the nature of her business. All signatures were presented and there are no concerns in the neighborhood. Gary Lyon asked about the application for a sign. Ms. Burge indicated the sign would be hanging from the front porch and would not exceed 150 square inches. There were no other concerns and Larry Bruno moved to forward a favorable recommendation to Price City Council for the Home Occupied Business of Classy Variety Nails. Penny Sampinos seconded and the motion carried.


III. CONDITIONAL USE PERMIT - SIGN

TRAILS END REALTY - CHARLA WATKINS AND COLLEEN DAVIS
RELOCATING TO 38 EAST 100 NORTH

Both Ms. Watkins and Ms. Davis came before the Commission to inform them that they would be moving to 38 East 100 North and would like to install their sign at the new location in a matter similar to the old location. There is a pole sign at the new address and they would like to make use of it in the future but will appear before this Commission for approval at that time. There is adequate parking behind the building and also three spaces on the street. Joe Piccolo indicated there is funding in the RDA for that particular area and suggested they contact Price City Planner Vern Jones for information and assistance. There were no concerns and Alfred Richens moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Trails End Realty for a sign. Laurel Marinos seconded and the motion carried.


IV. CONDITIONAL USE PERMIT - SIGN

A TOUCH OF APPEARANCE AUTO DETAILING
ERNIE HERRERA - 264 SOUTH CARBON AVENUE

Business partner Joey Herrera appeared on behalf of his business for approval of signs. Francis Duzenack indicated the permit for the business has been previously approved and Mr. Herrera is returning for sign approval. There is an existing sign frame on the front of the building from the previous tenant that the landlord is planning to split into three sections, possibly four, to accommodate other tenants. Because this business is out in the rear building, they would also like to also hang a sign on the south side of the building with an arrow pointing towards the back, where the driveway accesses the rear property. Mr. Duzenack indicated he had no concerns as all these signs meet the Price City Land Use Management and Development Code. Penny Sampinos moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - A Touch of Appearance Auto Detailing for signs. Gary Lyon seconded and the motion carried.


V. CONDITIONAL USE PERMIT - TEMPORARY SIGNS

BLACK DIAMOND STAMPEDE - WESTERN HERITAGE OUTLOOK ASSOCIATION
LISA MENDEL

Ms. Mendel, representing WHOA, appeared before the Commission to request approval for the use of temporary A-frame signs for advertisement during the Black Diamond Stampede. She indicated this had been done by the Chamber of Commerce in the past. They will be situated in the same locations and will be removed immediately following the rodeo. There were no questions or concerns and Larry Bruno moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Black Diamond Stampede/WHOA - for the use of Temporary A-frame Signs for advertisement of the rodeo. Penny Sampinos seconded and the motion carried.


VI. CONDITIONAL USE PERMIT - SIGN

MARKET EXPRESS CAR WASH - 121 NORTH CARBONVILLE ROAD

Mr. Kiahtipes appeared to discuss the request for permission by Price City for the construction of a sign at their new car wash facility. Chairman Angotti referred the Commission to the letter written by Price City Attorney regarding this request and discussion was opened on the matter. It was decided that creating a separate lot for the car wash would be in everyone's best interest. By creating a separate parcel of property, it becomes two separate businesses and allows a pole sign for the car wash business. However, the business license should remain under one ownership until such time as the property might be sold. Following discussion, Joe Piccolo moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Sign for Market Express Car Wash, contingent upon the fact that the property in question be surveyed and Mr. Kiahtipes return to Price City Planning and Zoning for approval of a single lot subdivision - the Market Express Car Wash property. Alfred Richens seconded and the motion carried.


VII. STAFF

A) INFORMATION - THOMAS DEVELOPMENT APARTMENTS

Francis Duzenack indicated he was presenting this information so the Commission would have current data concerning this project. He called attention to the project map showing six separate buildings with parking lots in between. They are showing this project with a dead end and are not planning any street development at this time. Price City would like to have a road in place from 300 South down to Fausett Lane - this is in the future road plan. The Price City Police Department was not in favor of this proposed arrangement and the Price City Fire Department recommends a turn-around in case of emergencies. Even with a turn-around, there will be traffic congestion in an emergency situation. Staff is recommending getting some type of road, if only a partial road. The Price City Land Use Management and Development Code requires that the developer be responsible for building the street as they develop their projects. Although Thomas Development does not want a through street in the project, Staff has approached them with the idea of separating the buildings and bringing the street straight through and putting the parking lot entrances to the street. They were not in favor of this idea and would rather have a closed project. There is a limitation on dead-end streets in the Price City Land Use Management and Development Code and it has already been exceeded in this area due to the fact that the existing project already in place, Carbon County Housing Authority, was built prior to the time of annexation. They now have plans for another complex in this same vicinity and there is concern about adding more traffic in this dead end road situation. With the additional development this apartment complex will generate, it will also take up considerable land for parking. All mentioned property is within the boundaries of Price City. If a street is put into place, the water system can be looped for better emergency services and water line maintenance. After some discussion on this matter, Joe Piccolo indicated he feels Price City should stand firm on the matter of the road being developed by the developer.


There was no further business and the meeting adjourned at 6:50 P.M.
