I.        MINUTES OF MAY 24, 1999

There were no corrections or additions and Penny Sampinos made a motion to approve the minutes of the May 24, 1999 Meeting as read. Gary Lyon seconded and the motion carried.

II.      HOME OCCUPIED BUSINESS - OFFICE USE ONLY

HEAVEN SCENT CANDLES - 705 NORTH 200 EAST - TRACIE NOYES

Ms. Noyes explained to Commission Members that there will be no inventory or parties on the premises and that orders will be delivered as soon as they are received. There were no concerns and Larry Bruno moved to forward a favorable recommendation to Price City Council for the Home Occupied Business - Office Use Only for Heaven Scent Candles. Laurel Marinos seconded and the motion carried.

III.     HOME OCCUPIED BUSINESS - OFFICE USES ONLY

PREMANUFACTURED HOME SERVICES - 349 NORTH 500 EAST
JIM MacLEAN

Mr. MacLean explained that his business is not considered a Handyman's Business, but services for pre-manufactured homes. This would consist of work done on pre-manufactured modular homes such as skirting, adjustment of doors and windows and other necessary repairs. Francis Duzenack indicated this type of business would fall into the maintenance category for maintenance of pre-existing modular homes. Thus, he would not need a contractor's license, unless he were to undertake new skirting and set-ups and things of that nature - then a contractor's license would be required.

There are no plans for a sign at this time. There were no concerns and Gary Lyon moved to forward a favorable recommendation to Price City Council for the Home Occupied Business - Office Use Only for Remanufacatured Home Services. Penny Sampinos seconded and the motion carried.

IV.     CONDITIONAL USE PERMIT

TEMPORARY PLACEMENT OF RV TRAILER IN
FLORENCE SUBDIVISION - LOT #5
USE AS A CONSTRUCTION OFFICE & TEMPORARY DWELLING
WILLIAM MIGLIACCIO, CONTRACTOR

Mr. Migliaccio was unable to attend and Francis Duzenack explained that the RV Trailer will be set on Lot #5 in order to allow the contractor to live on site. He plans to put a new manufactured home on Lot 13 for use as a spec home and would like the trailer to serve as an office as well as a security measure for the development. There were no concerns and Larry Bruno moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit for a Temporary Placement of an RV Trailer, for a period of one year, on Lot #5 in the Florence Subdivision. If Mr. Migliaccio feels he needs additional time at the end of that period, he may return to the Planning and Zoning Commission for an extension. Gary Lyon seconded and the motion carried.

V.      CONDITIONAL USE PERMIT - PRELIMINARY AND FINAL

David and Shauna O'Brien appeared before the Commission to present plans and details for their retirement residence. Phase I and II will be completed at the same time and will have a total of 29 units. Phase III will not be approved tonight. Larry Bruno asked if there was adequate parking. Residents may not be driving and transportation services will be provided, so there may be enough parking. After some discussion, it was decided parking was adequate, but when Phase III is added, parking facilities should be added to the property north of the building to accommodate the additional employees and residents. Price City Engineer Gary Sonntag also had some concerns. He asked if sidewalks along that area would be replaced or repaired; if stop signs would be installed coming out of the parking lot as well as situation of fire hydrants and street lights. Ms. O'Brien indicated she had not requested approval for a business sign as the location of the sign has not yet been determined. There were no other questions or concerns and Penny Sampinos moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Preliminary and Final Approval - for the Heirloom Retirement Residence, Phases I and II. Joe Piccolo seconded and the motion carried.

VII.   CONDITIONAL USE PERMIT

PROPOSED ACQUISITION OF SMALL PARCEL OF LAND
BORDERING THE NORTH PROPERTY BOUNDARY

Mr. Durrant appeared to request approval of a small parcel of land bordering his north property line in Elkridge Subdivision for landscaping purposes. There is a severe drop-off behind his property and the acquisition of this additional property will make landscaping that area much easier. Mr. Durrant is the only resident of the subdivision with this problem. The portion requested is a part of the original plan for a park or commons area in the subdivision. Joe Piccolo expressed his concern that although the developer is not trying to eliminate the commons area, any resident coming to Planning and Zoning and making a similar request, will have to be granted the same consideration. The Commission is setting a precedent and it must be fairly applied to every other resident.

Mr. Poloni told the Commission that the subdivision lots have now been increased to ½ acre lots and there will be 25 lots instead of the originally proposed 54 lots. Mr. Durrant is the only lot with this type of problem because of the incline of his rear lot. Without the additional property, his rear property cannot be effectively landscaped.

After some discussion, Joe Piccolo moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit for the Proposed Acquisition by Donald and Pamela Durrant of .0126 cres of Land Bordering the North Property Boundary Known as Elkridge Subdivision (330 West 800 South), contingent upon the fact that this is the only lot to be affected and that no further property will be relinquished as per the Planned Unit Development. Larry Bruno seconded and the motion carried.

VII. CONDITIONAL USE PERMIT - PRELIMINARY AND FINAL

BONNIE J. SUBDIVISION
100 SOUTH 700 EAST
EVAN HANSEN, REPRESENTATIVE

Laurel Marinos abstained from voting due to a conflict of interest in this matter. In the absence of Developer Jack Singleton, Evan Hansen made this presentation. He went over site plans and easements concerning this development. Tom Marinos, an adjoining neighbor of the proposed development asked questions concerning the location of the sewer line. Mr. Hansen explained that the sewer line will come through vacant land at about 250 South and the property for the sewer line has been purchased. There is a 10 foot wide public utility easement around all the lots and this will take care of the sewer between Lots 1 & 2 as well as Lots 7 & 9. The sewer will be stubbed out by Hogi Yogi and new development can tie into the sewer line. The water main will connect on 700 East and 100 South. The storm drain will empty into Meads Wash. Joe Piccolo asked if they intended to provide a crash gate on the northeast corner for emergency vehicles. Following discussion, it was determined that a crash gate will be installed at that location, with the cost to be determined by the developer. Lots 10-11 & 12 run to the center of Meads Wash and those people buying any of those lots will have to maintain the area along Meads Wash.

Mr. Marinos asked if the lots would be located in a flood plain because the channel is very narrow at that point and discussion was held on this matter. There is also the matter of the pie-shaped piece of property to the north of the Micoz Home. It was understood that Mr. Singleton will develop the area with the street coming out to 700 East and turn that piece of property over to the Micoz Family. Francis Duzenack indicated the Development Agreement has not yet been handled and must be part of the approval. There were no further questions or concerns and Gary Lyon moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit for Preliminary and Final Approval for Bonnie J. Subdivision with the following contingencies:

1) Development Agreement being drawn up and completed;

2) Construct a barricade to divide the street from CJ's to the point
    of the installed crash gate and said crash gate is to be
    permanently installed;

3) Easements:

Joe Piccolo seconded and the motion carried.

VIII. STAFF

A)      Information on Rosie's Deli

Francis Duzenack indicated Terry Fry is not yet in compliance with the 30 day request to improve the south parking lot with grade and road base. After some discussion, Joe Piccolo suggested forwarding a recommendation to Price City Council to review and refer this matter to the Price City Attorney for action.

There was no further business and the meeting adjourned at 7:25 P.M.
