A favorable motion to approve the minutes of July 9, 2007 as read was made by Commissioner Richens. Commissioner Sacco seconded the motion. Motion carried.

 

IV           HOME OCCUPIED PERMIT-BUSINESS-OFFICE USE ONLY-FINAL

                1125 NORTH 200 EAST-G & A WINDOW CLEANING-DAVID BLACK, OWNER

David Black requested a Home Occupied Business (HOB) office use only permit.  Mr. Black will be operating a window washing business for residential and commercial businesses. The home occupation is available by conditional use permit (CUP) under Section 10.3.4 of the Price City Land Use Management and Development Code.  Limitations regarding the HOB are indicated in Section 1.13.90 of the Price City Land Use Management and Development Code.  Within his application for the permit, Mr. Black indicates the storage of minor amounts of “on-hand” type supplies and equipment (soap, brushes, etc.).  It is recommended that the storage amounts, location, etc. be inspected by the Fire Chief and Building Inspector for safety of the neighborhood and a letter received for the file from each indicating the inspection and concurrence on the method. Staff recommends approval with the following contingencies:

    1. No employees working from the home;
    2. No unusual deliveries beyond typical FedEx, UPS, etc.;
    3. No on street parking of any vehicles, trailers, equipment, etc.;
    4. No unusual amounts of garbage or waste generated or disposed of from the home;
    5. No unusual electronic interference generating from the business;

g.    No dust, odors, noise or other contamination generating from the business;

                Mr. Black stated that both the building inspection and fire inspections have been completed.

MOTION. Commissioner Shook moved to approve the Home Occupied Business office use only permit for G & A Window Cleaning. Motion seconded by Commissioner Lyon and carried.

V             HOME OCCUPIED PERMIT-BUSINESS AND SIGN-OFFICE USE ONLY-FINAL

                565 WEST 800 SOUTH- KD REAL ESTATE-KATHY DIAMANTI, OWNER

Kathy Diamanti requested a Home Occupied Business (HOB) office use only permit.  The business will be a real estate brokerage business office. The permit is available by conditional use permit (CUP) under Section 10.3.4 of the Price City Land Use Management and Development Code.  Limitations regarding the HOB are indicated in Section 1.13.90 of the Price City Land Use Management and Development Code. Staff recommends approval of the business with the following contingencies:

a.     No employees working from the home;

b.     No unusual deliveries beyond typical FedEx, UPS, etc;

c.     No on street parking of any vehicles, trailers, equipment, etc;

d.     No unusual amounts of garbage or waste generated or disposed of from the home;

e.     No unusual electronic interference generating from the business;

    1. No dust, odors, noise or other contamination generating from the business;

No sign will be placed at the home. MOTION. Commissioner Lyon moved to approve this Home Occupied Office Use Only permit for KD Real Estate with listed contingencies. Motion seconded by Commissioner Shook. Motion carried.

 

VI           CONDITIONAL USE PERMIT- ELKRIDGE SUBDIVISION-PRELIMINARY AND

                FINAL- 800 SOUTH 600 WEST-FAIRGROUNDS ROAD-PHASE IV-T.H AND LINDA

                POLONI, OWNERS

T.H. Poloni is requesting preliminary and final approval of Elk Ridge Subdivision Phase 4. Phase 4 consists of 5 residential lots, located in the vicinity of Fairgrounds Road/800 South and 600 West. The subdivision is permitted by Conditional Use Permit (CUP) under section 10.3.13 and the Planned Unit Development nature of the development is permitted by CUP under Section 10.3.14 of the Price City Land Use Development and Management Code. Recommended verifications of development matters prior to the issuance of final approval include:

·         Concurrence of Price City Public Works Department on storm water management plans

·         Completion of qualified geotechnical report soil study

·         Submission of statement regarding environmental conditions

·         Provide verification and/or evidence of utility connectivity

·         Completion and submission of final site plan and subdivision plat in Mylar form.

Staff recommends approval with submission of stated development issues. Mr. Poloni stated that soil studies were turned in with concept approval of Phase I and that the utilities are all extended as the phases are each implemented. MOTION. Commissioner Nielson moved to approve the final as written with contingencies. Commissioner Sampinos seconded the motion. Motion carried.

 

VII          CONDITIONAL USE PERMIT- FLORENCE SUBDIVISION- PHASE II-FINAL

                APPROX. 1400 EAST 800 NORTH- TONY BASSO, OWNER

Tony Basso requested final approval for Florence Subdivision, Phase II. Mr. Basso has provided Price City with the storm water information and spoken to Sam White of the Price City Water Department. He has also contacted Ken Harney of Price City’s Electrical Department, Questar Company, Precis Communication and Utah Power and Light. Mr. Basso has brought a signed agreement and a final Mylar for signatures. The subdivision is situated within the SF-6 zone at approximately 1400 East 800 North.  The subdivision approval is available under Section 10.3.13 of the Price City Land Use Management and Development Code. Mr. Basso will complete the following items:

·         Submission of surety guarantee for public improvements as required therein;

·         Submission of a minimum of 3 copies of final subdivision plat to Price City in 24” X 36” format.

MOTION. Commissioner Shook moved to provide final approval for a residential subdivision, Florence Subdivision Phase II, located in the SF-6 zone at approximately 1400 East 800 North to Mr. Tony Basso subject to the listed contingencies. Commissioner Richens seconded the motion. Motion carried.

 

VIII        CONDITIONAL USE PERMIT- MSHA BUILDING-PRELIMINARY APPROVAL

                1365 SOUTH CARBON AVE. BUILDING #3- C.V. LLC.

Rick Carlton presented this request for preliminary approval of a new MSHA office at 1365 South Carbon Avenue building #3. Staff recommends approval upon the completion of the following and recommends placing this item on the next agenda for final approval:

·         Final site plan submitted with reference to storm water runoff containment and control;

·         Completion of the development agreement(s) necessary & required by the Price City Public Works Department relative to the public improvements required by the development;

Mr. Carlton stated that the storm water runoff containment and control forms had been turned in to Price City recently.

MOTION. Commissioner Nielson moved to provide preliminary approval for the MSHA Building, with written contingencies as listed. Motion seconded by Commissioner Lyon and carried.  

 

IX           CONDITIONAL USE PERMIT-GEORGETOWN DEVELOPMENT-CONCEPT ONLY

APPROX. 1700 EAST 400 NORTH-WITHIN AMERICAN DREAM SUBDIVISION- JOHN DESTER, OWNER

Paul Washburn represented this request on behalf of John Dester for the Georgetown Development town homes within the American Dream subdivision for concept approval.  There are 2 times for review and consideration within this application:  (1) consideration of a conditional use permit for a Planned Unit Development (PUD) for the town home section of the development; and, (2) consideration of a subdivision request for the PUD project boundary.  The PUD is available under Section 10.3.14 of the Price City Land Use Management and Development Code and the subdivision is available under Section 10.3.13 of the Price City Land Use Management and Development Code.  Section 10.3.3.7 (groups of dwellings when approved as a planned unit development) should also be reviewed and considered for this concept approval request.  The PUD developer, Mr. John L. Dester, is planning to develop the PUD in 3 to 4 phases, depending upon sales of within the PUD, subsequent to the concept approval. The PUD will have homeowner association fees that include maintenance, cable, snow removal etc. Streets will be built to city standards with the maintenance of the streets completed by the association fees.  All of the street lighting will be placed within city standards as well as fire hydrant requirements. There will be a concrete area for recreational vehicle storage. Soil surveys were completed before the property was purchased. Two styles of homes will be built in four phases. The homes have been built in other areas by Georgetown Design for 28 years.

It is the recommendation of staff to provide a recommendation for concept approval for the Georgetown Development town homes, within the boundaries of the American Dream subdivision and to provide concept approval for the subdivision of the land necessary to facilitate the PUD development.  Mr. Dester should be requested to complete the following prior to submission of the subdivision and PUD for preliminary or final approval:

·         Submission of a qualified geotechnical study incorporation the area and referencing grade/fill matters, subsurface soils and allowable soil bearing pressures;

·         Submission of a engineered storm water management plan for the PUD indicating flows within the PUD, containment, release and disbursement of the storm water compatible with the surrounding American Dream subdivision;

·         Evidence of utility connectivity from all utility providers;

·         Completion of environmental review consistent with Section 3.3.6 of the Price City Land Use Management and Development Code;

·         Completion of development agreement for public infrastructure with the Price City Public Works Department;

·         Submission of proposed PUD homeowners’ association agreements regarding maintenance and operation of the PUD.

MOTION. Commissioner Richens moved to provide concept approval to Mr. John L. Dester for the Georgetown Development PUD contingent upon submission of the listed contingencies. MOTION. Motion Seconded by Shook.

 

X             CONDITIONAL USE PERMIT-AMERICAN DREAM SUBDIVISION-PRELIMINARY

PHASE I- APPROX. 400 NORTH 1500-1600 EAST-PAUL WASHBURN/JULIE SMITH, OWNERS

Paul Washburn requested preliminary approval for the American Dream Subdivision, Phase 1. It is the recommendation of staff to provide preliminary approval only for American Dream Subdivision, Phase 1 development at this time for the first 20 lots. Mr. Washburn would like to begin the grading process soon as possible. The City Engineer is in the process of verifying the grade plan so Commission approval is required. Traffic studies, site plans, storm water drainage plans, geotechnical studies have all been submitted to the Price City Public Works department and are under review at this time. Prior to final approval the following needs are requested:

·         Final subdivision plat prepared with updated signature block style in Mylar copy;

·         Completion of the development agreement(s) necessary & required by the Price City Public Works Department relative to the public improvements required by the development;

·         Completion of review and approval of the grade and fill plan by the Price City Public Works Department.

MOTION. Commissioner Lyon moved to approve Paul Washburn and Julie Smith for the American Dream Subdivision, Phase 1 with listed contingencies and approval to begin the grading stage of the project. Motion seconded by Commissioner Sampinos. Motion carried.

 

XI      UNFINISHED BUSINESS

                 1.  Pinnacle Canyon Academy:

                      a. Building Inspection walk through and recommendations by 9-1-07

b. All plat revisions, public right-of-way dedications, improvement design completed by

12-31-07

                      c. Completion of development agreement requirements by 7-1-08

                      d. Completion of off street parking requirements by 7-1-09

 

                2.   Discussion on the updates for the following:

·         Imagination Station letter to owner

·         Castle Country Fencing letter to owner

·         Stonecold Waterscapes update

·         Real Property Management Draft

·         Replacement selections for a Planning and Zoning Commission position

 

The Commission reviewed and discussed the unfinished business items and expected completion dates.

Commissioner Lyon motioned to adjourn. The meeting adjourned at 6:49 p.m.
