MINUTES OF JULY 26, 2005

I           PLEDGE OF ALLEGIANCE

            Larry Bruno led the Pledge of Allegiance.

 

II         ROLL CALL

            The above members were in attendance and a quorum present.

 

III        MINUTES OF JULY 11th, 2005

Gary Lyon requested the following change be made to the minutes of July 11th, 2005.

1)         Page 3, Paragraph 2, Line 5 to read: “North side” in place of “West”

A favorable motion to approve the minutes of July 26th, 2005 as amended was made by Gary Lyon. Alfred Richens seconded the motion. Motion Carried.

 

IV        CONDITIONAL USE PERMIT- BUSINESS AND SIGN FINAL-FIREFOX MINI STORAGE UNITS-BRAD HARPER- 345 EAST 100 NORTH

            Brad Harper presented this request for an 18 (10 x 10) mini storage units building behind his home located at 345 East 100 North. Eventually this home will be used as an office for the Dominoes Pizza located on Price main street. A 6’ gated and locked fence will extend from the back of the home to be opened by owner to let the renters in and out of the property.  A 4 x 6 sign will hang from the fence with the name and phone number of the business. This is the only sign that will be used.  A back door on the home will be used for access into the yard.  The home and yard are currently being updated and refinished for acceptable living and office space. All of the dirt work is being done to plan for the building installation and driveway entrance. The driveway will be used as access to the storage units which needs to be widened to 25’ per the planning committee. This will lessen the impact of traffic onto the main road. This road must stay 3’ away from the West property line. Gravel will be placed onto the driveway for now until pavement can be placed. Drainage will follow arrows on plat map. Staff has given Mr. Harper the sign requirements and would also recommend washed rock to be placed on top of the gravel to keep the mud from tracking onto the main road. An obscuring fence on all sides where there is residential occupied properties is required. Mr. Harper told the commission that a parking lot is on one side of the property and vacant lots are on the other side and only a vacant barn to the back of the property.  An obscuring fence on both sides and rear is recommended by the commission. Front gate does not need to be obscured. A favorable motion for a Conditional Use Permit Business and Sign final with the following conditions: Driveway needs to be widened and paved with gravel and clean rock then paved within 24 months with either asphalt or concrete pavement, the sign kept within city requirements and an obscuring fence placed next to residential occupied properties was made by Gary Lyon. Penny Sampinos seconded the motion. Motion Carried.

Item 1- The Mayor recommended the appointment of Ed Shook as the new P & Z Boardmember which will be on the July 27th City Council meeting agenda. As well as the reappointment of Alfred Richens and ratification of Larry Bruno as Chairman and Gary Lyon as Vice Chairman.

 

Item 2-Jeanne McEvoy requested a discussion regarding information from the planning commission as to

the grandfather law on billboard signs.  As a board we approved the changing of the sign for Castleview Hospital on the Eastern Utah Produce Building in April of 2005. The requirements for a billboard sign are now under the new laws. A billboard sign can only be terminated as per state law to meet the new requirements, if the sign is given as a gift or purchased from owner. A billboard can have a change of copy but cannot be enlarged or have physical changes other than just a copy. The location of the billboards are the grandfathered item in question not the wording on the sign. Once a grandfathered sign is removed for (365) days it cannot be put back in the same place. Non-conforming signs are allowed to remain now because of the grandfather law.

           

There was no further business and Gary Lyon moved to adjourn. The meeting adjourned at 6:22 P.M.
