III        MINUTES OF AUGUST 7, 2006

A favorable motion to approve the minutes of August 7, 2006 as read was made by Commissioner Richens. Commissioner Shook seconded the motion. Motion Carried.

 

IV        HOME OCCUPIED USE PERMIT-BUSINESS-FINAL

            1483 SAGEWOOD RD. – DELAYNA BARR, OWNER-DBA DELAYNA’S SALON AND MISS DELAYNA’S PRESCHOOL

            Delayna Barr presented this request for a Hair Salon and a Preschool in her home. The Preschool will be held in the basement of her home with 8 children attending at one time, twice a week from 10 a.m. to 2 p.m. The hours will alleviate traffic in the area and not cause congestion in the early morning traffic. The Hair Salon will be upstairs. The basement has two large windows 2 ˝ feet off the ground for a fire escape. The Commissioners would like the home inspected by the Fire Marshall before Mrs. Barr opens her home to the public. A favorable recommendation for a Home Occupied Business Final was made by Commissioner Shook contingent upon a fire inspection and the question of required licensing for a preschool will be sent to the City Attorney for clarification. Commissioner Sacco seconded the motion. Motion carried.

 

V         HOME OCCUPIED PERMIT-BUSINESS-OFFICE USE ONLY-FINAL

876 N. 400 E.-BILL VANDESLUIS PHOTOGRAPHY-BILL VANDESLUIS, OWNER

            Bill Vandesluis presented the request for an Office Use Only photography business at his home. The business will not have a studio and all printing will be sent out of state for developing. There will be no impact to the neighborhood as there will be no traffic or business sign, just the occasional delivery from UPS. Staff recommends approval. A favorable recommendation for a Home Occupied Business Final was made by Commissioner Richens. Commissioner Shook seconded the motion. Motion carried.

 

VI        CONDITIONAL USE PERMIT-BUSINESS AND SIGN-FINAL

            140 E. 100 SO.-SOUTHERN CUSTOM AND COLLISION-NOAH BEHUNIN            

Noah Behunin presented this request for an insurance collision repair shop in a CD zone. The work will be done as needed with no stockpiling of vehicles. Mr. Behunin will have a paint booth which will be an oxygen (in and out) filtering system with a hood and exhaust that leads out of the building. Pressurized paint booths do not require certification. All chemicals and liquids will be dumped in a recycle bin for a recycling company to collect the chemicals as necessary. PRWID has been contacted for an Industrial Waste Survey. All cars will be stored inside and not on the street or behind the building. The compressor being used will have a contained room built around it in order to keep the sound at a minimum. The Commissioners are requiring a fire inspection of the building and the paint booth. There are 3-4 parking stalls out in front of the building for customer parking. The owner will park on the side of the building to keep front parking available to customers. The shop will be open during 8 a.m. to 5 p.m. The sign will be done according to city standards. A favorable recommendation for a Conditional Use Permit Business and Sign Final contingent upon a fire inspection was made by Commissioner Shook. Commissioner Richens seconded the motion. Motion carried.

 

VII      CONDITIONAL USE PERMIT-BUSINESS-FINAL

140 NORTH CEDARHILLS DRIVE-ENCORE DANCE STUDIO-JULIA TATTON, OWNER

Julia Tatton presented this request for a dance studio in the building owned by Jerry Carlson behind Smith’s. The studio will be located in the clubhouse that currently has a wood floor, ADA access and parking. Staff recommends this business. A favorable recommendation for a Conditional Use Permit Business Final was made by Commissioner Richens. Commissioner Sacco seconded the motion. Motion carried.

 

VIII     CONDITIONAL USE PERMIT-AMENDMENT-FINAL

150 NORTH CARBONVILLE ROAD, AUTO ALLEY-FRED JONES, OWNER

Fred Jones presented this request for an amendment to his Conditional Use Permit for Auto Alley on Carbonville Road. Mr. Jones needs more space to sell used vehicles and would like to change his current 12 car limit to 20-25 cars. He would like to place a 6’ sight obscuring fence behind the building to keep the cars that need to be fixed out of sight and the ability to work on vehicles to get them running. He is currently working with surveyors to determine where the fence line lies. Commissioner Sacco does not want to approve this without knowing that information. Mr. Jones will get with the owners of the property to find the fence line and possibly set up an agreement.  Commissioners are concerned with the maintenance of the property and the amount of cars that are sitting idle. Mr. Jones has leased some property in the County to store the non-working vehicles, which will take him approximately 2 weeks to move the vehicles. The space on the lot where business transactions take place and cars are sold needs to be paved.  PRWID has been contacted and Mr. Jones is working on a Industrial Waste Survey for the new work he would like to do in his shop. The Commissioners will approve the amendment to Auto Alley’s Conditional Use Permit on the completion of the following mandatory contingencies: (a copy of the minutes will be hand delivered and mailed to Mr. Jones on August 22nd regarding the contingencies)

1.         Cars to be sold need to be parked on a hard surface.

2.         The property needs to be surveyed and adjoining property owners notified before a 6’ sight obscuring fence can be installed.

3.         Price City will need a copy of the railroad right-of-way and a letter from the adjoining property owners before a fence can be installed.

4.         Maximum of 15 cars can be displayed for sale at one time.

5.         The property must be cleaned up and maintained with no visible car parts or non-working vehicles.

6.         A copy of the Industrial Waste Survey from PRWID needs to be on file with Price City.

7.         Mr. Jones will be given 30 days for the removal of all non-working cars and parts and a fence placed around the area chosen for non-working vehicles.

 

A favorable recommendation for a Conditional Use Permit Amendment with the completion of the above contingencies with a time allowance of one year to get the property cleaned was made by Commissioner Richens. Commissioner Sacco seconded the motion. Motion carried.

 

IX        STAFF-

            STEVE MANZANARES-CASTLE COUNTRY FENCING

            Mr. Manzanares did not attend the meeting as instructed by the Planning and Zoning Commission.

 

There were no further items on the agenda and Commissioner Richens moved to adjourn. The meeting adjourned at 6:50 P.M.
