MINUTES OF AUGUST 23, 2004 - 6:00PM

I           PLEDGE OF ALLEGIANCE

            The Pledge of Allegiance was led by Chairman John B. Angotti.

 

II         ROLL CALL

            The above members were in attendance and a quorum present.

 

III        MINUTES OF AUGUST 9, 2004

            There were no additions or corrections and Gary Lyon moved to approve the Minutes of August 9,       2004, as read.  Penny Sampinos seconded.  Motion carried.      

 

IV        HOME OCCUPIED BUSINESS - OFFICE USE ONLY

            JOHNNY'S LANDSCAPING - 320 WEST 300 SOUTH

            JOHN E. SANCHEZ, OWNER

            Mr. Sanchez told the Commission he will be doing rock landscaping to replace lawns in people's            yards.  The only equipment he will have at his home will be his truck and trailer which will be            used to pick up the rock from local retailers.  Any other equipment he may need will be rented.        Nothing will be stored at his home.  He will advertise in the newspaper and have a sign on his          vehicle.  There were no other questions and Larry Bruno moved to forward a favorable          recommendation to Price City Council for this Home Occupied Business.  Gary Lyon seconded             and the motion carried.

 

V         HOME OCCUPIED BUSINESS - OFFICE USE ONLY

            FOSSAT'S POWER WASH - 720 EAST 800 NORTH

Mr. Fossat was not present and Alfred Richens moved to table the item.  Gary Lyon seconded.             Motion carried.

 

VI        CONDITIONAL USE PERMIT - BUSINESS AND SIGN

            PRELIMINARY AND FINAL - 590 EAST MAIN

            DOMINO' S PIZZA - BRAD HARPER, MANAGER

            Mr. Harper explained the business will be carry-out and delivery only.  Part of the building will be          remodeled for the business with the other part remaining office space.  There are 7 parking             spaces reserved for employees with many customer parking spaces available.  PRWID is currently   working with Mr. Harper concerning the sampling manhole.  The signs will include a 50 square          foot sign on the building and a 50 square foot pole sign with a 32 square foot reader board on the     corner of the lot opposite the Best Western sign.  Alfred Richens moved to forward a favorable             recommendation for this business and sign.  Penny Sampinos seconded and the motion carried.

VII      CONDITIONAL USE PERMIT - RATIFICATION

            FAUSETT SUBDIVISION -JERRY CARLSON, OWNER

            Mr. Jim Shorts, representing Jerry Carlson, was given a head nod approval for this concept at the          last meeting of Planning and Zoning.  Larry Bruno moved to forward a favorable recommendation    for this concept.  Frankie Sacco seconded and the motion carried.

 

VIII     CONDITIONAL USE PERMIT - PRELIMINARY AND FINAL

            AMENDED FAUSETT SUBDIVISION - CEDAR HILLS DRIVE

            JERRY CARLSON, OWNER

            Francis Duzenack explained that Mr. Carlson will need to have a mylar copy of the amended     subdivision to be signed by the City Engineer, Commission Chairman, etc.  Larry Bruno moved to            forward a favorable recommendation for this Conditional Use Permit, preliminary and final,   contingent upon review by the City Engineer.  Penny Sampinos seconded and the motion carried.

 

IX        CONDITIONAL USE PERMIT - BUSINESS AND SIGN

            836 EAST 100 NORTH #4&5 - KINDER COTTAGE PRESCHOOL

            CAMEON PATTERICK, OWNER

            Ms. Patterick explained she will hold pre-school classes throughout the school year.  She has three        teachers working for her holding 3 two-hour sessions with 15 children per session three days a    week.  She stated there are parking spaces in front of the building but parents generally drop the       children off.  A teacher stands in front of the building to make sure the kids make it safely inside             the building.  She stated they would put a small 8 1/2" X 11" sign in the window if they decide to           use a sign.  Gary Lyon moved to forward a favorable recommendation for this business and sign      contingent upon having a fire inspection done.  Frankie Sacco seconded.  Motion carried.

 

X         CONDTIONAL USE PERMIT - AUXILLARY BUILDING

            893 NORTH 400 EAST - NEW GARAGE

            DICKSON MORLEY, OWNER

            It was explained Mr. Morley plans to build a garage on a portion of the 11 acre lot adjacent to his         home.   As the garage will not be on the same lot as a home, a single lot subdivision will need to       be requested.  Francis Duzenack explained a Master Plan for the lot and any building planned on the lot must be submitted for Preliminary and Final approval.  He also stated the Commission would   need to decide what to do concerning utilities and street improvements because eventually         the 11 acres will be developed.  Penny Sampinos moved to forward a favorable recommendation          for this concept.  Alfred Richens seconded.  Motion carried.

 

XI        CONDITIONAL USE PERMIT - PRELIMINARY AND FINAL

            37 EAST MAIN - AVIARY

            EDDIE HORVATH, OWNER
           
Mr. Horvath stated he is scheduled to meet with Anderson heating and Plumbing on Wednesday,           August 25, 2004, in order to get a quote for the installation of a ventilation system.  Larry Bruno      moved to table this item pending further information on the ventilation system and the letter from   Mr. Horvath concerning conformation with the City Animal Regulations.  Gary Lyon seconded        and the motion carried.

XII      CONDITIONAL USE PERMIT - LOT LINE ADJUSTMENT

            298 WEST 200 NORTH - ROGER HUNT, OWNER

            Mr. Hunt explained his family owns three connected lots and he would like to move one property           line in order to separate an orchard from the area where a mobile home sits. The lots would still        exceed the minimum size required for that zone.  He was informed he would need to fill out new    property descriptions with Carbon County and a Notice of New Legal Description with Price City.             Alfred Richens moved to forward a favorable recommendation to City Council for this lot line   adjustment.  Gary Lyon seconded and the motion carried.

 

XIII     CONDITIONAL USE PERMIT - BUSINESS AND SIGN

            1075 EAST MAIN - MAURICE'S CLOTHING STORE

            It was explained the clothing store will be located in the former Briccone's building.  They will     utilize the existing signs by making copy changes.  There are 11 parking spaces in front of the        building with plenty more parking available in the shopping center lot.  There were no other             concerns and Larry Bruno moved to forward a favorable recommendation for this business and    signs.  Penny Sampinos seconded and the motion carried.

           

XIV     CONDITIONAL USE PERMIT - PRELIMINARY AND FINAL

            600 NICK LANE - LOVELESS ASH PHASE I - MIKE AND COLLEEN LOVELESS

            The Loveless's explained their manufacturing has outgrown their current building.  Staff   recommended since most of the road work being done will be UDOT's property, that Price City       postpone required street improvements until a development agreement has been made with      UDOT and Price City.  The current sewer line will be extended to the end of the property and           will be installed with the new building.  Gary Lyon moved to forward a favorable             recommendation for this Conditional Use Permit, preliminary and final, contingent upon a           completed development agreement.  Larry Bruno seconded and the motion carried.

 

XV       CONDITIONAL USE PERMIT - SIGN

            410 WEST 100 NORTH - TOOL SOURCE - BOYD ANDERSON

            Mr. Anderson stated the sign is 17' long and 6' high.  It is within the maximum square footage     allowed.  Gary Lyon moved to forward a favorable recommendation to Price City Council for this     sign. Larry Bruno seconded and the motion carried.

 

XVI     CONDITIONAL USE PERMIT - CONCEPT

            1481 EAST 800 NORTH - CASTLE VALLEY LANDSCAPING PHASE I

            BOYD ANDERSON, OWNER

            Mr. Anderson explained his plan to make two large storage containers into a permanent building.           He stated he would return with more details including a site plan, engineering for the building, drainage plan, etc.  Larry Bruno moved to forward a favorable recommendation for this concept    stating Mr. Anderson must return to Planning and Zoning for Preliminary approval within 60 days.     Penny Sampinos seconded and the motion carried.
