MINUTES OF NOVEMBER 6, 2006

III            MINUTES OF OCTOBER 23, 2006

A favorable motion to approve the minutes of October 23, 2006 as read was made by Commissioner Lyon as amended. Commissioner Shook seconded the motion. Motion carried.

 

Minutes were amended to replace “Chairman Bruno” with “Commissioner Lyon” leading the Pledge of Allegiance.

 

Chairman Bruno changed the order of the agenda to have item VI be considered before Items IV and V due to the length of discussion associated with both items.

 

IV            CONDITIONAL USE PERMIT-BUSINESS AND SIGN-FINAL

                63 E. MAIN- A SCENT AWAY FROM HEAVEN-GARY AND SHERRI MITCHESON, OWNERS

Sherri Mitcheson presented this business proposal for new store in Price. The store will provide women with specialty bath and body items, candles and gift baskets. Staff recommends this business with the requirement that the owners park behind the building. At this time, the owners will not have a sign on the building. The sign will be on the inside of the front store window. The sign will be 3 x 6 in size with the store name surrounded by a bathtub and bubbles. A favorable motion to approve the Conditional Use Permit Business and administrative review of the sign when ready was made by Commissioner Shook. Commissioner Nielson seconded the motion. Motion carried

 

V             HOME OCCUPIED PERMIT- BUSINESS –FINAL

                337 NORTH 5TH AVENUE-CASTLE COUNTRY FENCING AND TREE SERVICE, LLC.

MARIE AND STEPHEN MANZANARES, OWNERS

Stephen Manzanares returned to Planning and Zoning to request a continuance of his Home Occupied Business at the address of 337 North 5th Avenue. The business storage will be managed at 415 E. 300 N. which is located next to the Manzanares property. The conditions for the fencing business will follow the specifications of the Commission:

·         Space used for storage of “on hand” materials or 168 sq. ft of space-not to exceed 21’ x 8’

·         Storage of items is only permitted to be on the back edge of the property up against the fence line.

·         Storage items will only be stored on pallets

·         Storage items will be covered at all times and remain presentable

·         A sight obscuring fence will be installed at the sides and rear of the storage area

·         Fittings, top rail, gates, fence fabric and fence posts are the only listed  items to be stored

·         Items are to remain minimal to only what will be used on a daily basis

·         Vehicles used for the business are not allowed to park at the home, this includes trucks and trailers.

·         The home is to be Office Use Only.

·         Customers and employees are not to come to the home for business.

·         Inoperable or damaged vehicles are to be removed from the property within 60 days of this meeting.

·         Vehicles are not to be parked on the city sidewalks or designated paths.

·         Mr. Manzanares will be allowed 9 months to find and relocate his business and storage to another location within a CD zone. If by September 1, 2007, he is not able to commit to this stipulation, he must return to Planning and Zoning on his own accord and report to the Commission. The only permitted use will be Office Use Only at the address of 337 North 5th Avenue on 9/1/07. MOTION. Commissioner Shook gave a favorable motion to the Conditional Use Permit with the contingencies set forth for Castle Valley Fencing. Motion seconded by Commissioner Nielson. Motion carried.

VI            CONDITIONAL USE PERMIT-BUSINESS AND SIGN-FINAL

                950 EAST 100 NORTH- CASTLE COUNTRY FENCING AND TREE SERVICE, LLC.

A favorable motion to strike Item V from the Agenda was made by Commissioner Lyon. Motion seconded by Commissioner Nielson. Motion carried.

 

VII          STAFF- Update Lot Line Adjustment

 

There were no further items on the agenda and Commissioner Lyon moved to adjourn. The meeting adjourned at 7:07 P.M.
