MINUTES OF NOVEMBER 20, 2006

III            MINUTES OF NOVEMBER 6, 2006

A favorable motion to approve the minutes of November 6, 2006 as amended was made by Commissioner Lyon. Commissioner Nielson seconded the motion. Motion carried.

 

IV            HOME OCCUPIED PERMIT-BUSINESS AND SIGN-FINAL

                290 WEST 500 SOUTH-TREND SETTERS-TERRI PIERCE, OWNER

Terri Pierce presented this request for a part-time hair salon in her home. Mrs. Pierce has received the appropriate neighborhood signature approvals. The home does need fire extinguishers which the Fire Chief will request during his inspection per the business license process. Parking is not an issue and only one car per visit will be allowed at one time. Staff recommends approval for this Home Occupied Business. Mrs. Pierce will be using a small sign at the corner of her yard to show direction to the home entrance. MOTION. A favorable motion to approve the Home Occupied Permit Business Final was made by Commissioner Sampinos. Commissioner Lyon seconded the motion. Motion carried.

 

V             CONDITIONAL USE PERMIT- BUSINESS AND SIGN-FINAL

                140 NORTH CEDAR HILLS DRIVE- KARA’S COUNSELING-KARA HEUGLY, OWNER

Kara Heugly presented this request to add a professionally licensed counseling business in the back upstairs section of what is now Heugly & Heugly Law Offices at 140 N. Cedar Hills Drive. The practice will have its own private entrance into the clubhouse building. A 4 x 8 sign will be located on the front lawn area with a sketch of the sign turned into Nick Tatton for approval. There shouldn’t be a problem with parking as clients usually come one appointment at a time. Staff recommends approval.  MOTION. A favorable motion to approve the Home Occupied Permit Business Final was made by Commissioner Sampinos approve sign upon review. Commissioner Lyon seconded the motion. Motion carried.

 

VI            CONDITIONAL USE PERMIT-BUSINESS AND SIGN-FINAL

                495 SOUTH HIGHWAY 55-MANUFACTURED HOME SALES-TONY BASSO, OWNER

Tony Basso presented this request to add a manufacturing home sales business on the property of 495 South Highway 55. The paved section of the property will be used for the display of modular homes. Two of the homes will be equipped with electricity and plumbing for showing purposes, one will be used for an office. No structures will be built on the property at this time only a storage shed in the back of the property will be temporarily set up. White vinyl fencing will be installed for presentation. The sign will be placed on the corner of the lot on Fausett Lane, it will be built out of brick, low on the ground with stucco for decoration. The sign can be approved administratively under the new sign code.  Staff recommends approval. MOTION. A favorable motion to approve the Conditional Use Permit business and sign final was made by Commissioner Lyon upon sign approval review. Commissioner Sampinos seconded the motion. Motion carried.

 

VII          CONDITIONAL USE PERMIT-SUBDIVISION-CONCEPT ONLY

                4th, 5th, 6th WEST 400 SOUTH-ROBERT MILLER, OWNER

Robert Miller presented this request for a proposed subdivision concept only. The easement for drainage on the property still needs to meet the City Engineers approval. Mr. Miller would like to bring the drainage South and then North and over for better drainage for the entire subdivision. Mr. Miller stated that Mr. Sonntag, Mayor Piccolo and the City staff have been notified of his intentions for this subdivision a couple of years ago. He stated that the City wanted him to create a cul-de-sac at the end of the road but, he didn’t feel that it was necessary for future growth. He would still like to create a dead end instead of a cul-de-sac for the area instead of closing the area off.  The zoning in the area is MR-7. Staff approves of this subdivision proposal for concept only. A drainage plan from Mr. Miller will need to be turned in to the City Engineer. There will need to be a turn around area at the end of the street of 160’ possibly utilizing the southern most lots until the subdivision is complete. The engineering department will now need to work with Mr. Miller on this proposal. MOTION.A favorable motion to approve this Conditional Use Permit Concept Only was made by Commissioner Nielson. Commissioner Lyon seconded the motion. Motion carried.

 

VIII         CONDITIONAL USE PERMIT-SUBDIVISION AMENDMENT-FINAL

                890 N. 1400 E. - M & T HOMES- MIKE JORGENSEN, MANAGER

Mike Jorgensen presented this subdivision amendment to combine lots #7 and #8 together. Lot #7 is not large enough to add a shed and the owners would like to have more property to work with. Lot #8 isn’t in the subdivision as of yet and therefore will need Planning and Zoning approval.  Clay Holbrook of Professional Title has created a new subdivision plat to include the new lot. The new plat will be brought to Price City for signatures and then to Carbon County for recording as soon as possible. The owners will now own lots 7 and 8 as one combined lot. MOTION. A favorable motion to approve the Subdivision Amendment Conditional Use Permit Final contingent upon the updated plat map was made by Commissioner Lyon. Commissioner Nielson seconded the motion. Motion carried.

 

IX            HOME OCCUPIED PERMIT-BUSINESS-OFFICE USE ONLY-FINAL

                1550 EAST 800 NORTH-THE MANTHA COMPANY CONSULTING-NICK TATTON, OWNER

This will be a Home Occupied Office Use Only consulting business in the home of 1550 East 800 North for Nick Tatton, Owner. A favorable motion to approve the Home Occupied Office Use Only Business Final was made by Commissioner Nielson. Commissioner Lyon seconded the motion. Motion carried.
