MINUTES OF JANUARY 9, 2006

I           PLEDGE OF ALLEGIANCE

            Chairman Bruno led the Pledge of Allegiance.

 

II         ROLL CALL

            The above members were in attendance and a quorum present.

 

III        MINUTES OF DECEMBER 12, 2005

A favorable motion to approve the minutes of December 12, 2005 was made by Commissioner Shook. Commissioner Sampinos seconded the motion. Motion Carried.

 

IV            HOME OCCUPIED BUSINESS-OFFICE USE ONLY-FINAL

645 N. HOMESTEAD BLVD.-GOOD SENSE POOL HOTTUB AND SOFTENER SERVICE-AM/PM PAINTING AND CLEANING- ARLAND AND MARIE LEONARD,OWNERS

Marie Leonard presented this request. This business will be a cleaning service for hot tub and swimming pool owners. This would include the upkeep of filters, a general maintenance regimen and cleaning with non-toxic chemicals. The business would also include supplying salt for water softener systems in homes and filling the tanks for customers on a scheduled basis. The Leonard’s will also provide spring cleaning and painting services for interested parties. All chemicals will be purchased at licensed suppliers and will be picked up as needed. Some necessary supplies may be stored inside of the home which would include filters, chlorine and/or bromine. The Leonard’s will attend a CPL class in Moab as soon as possible. Commissioner Shook asked if there would be  acids stored in the home and was assured there would not be. The chlorine being stored would be a solid granule chlorine and the bromine would be in tablet form. The supplies will be stored in a closet by the office space for dry storage. MSDS sheets will be available. No sign will be added to the home at this time. Staff recommends this business as supplies being stored are not inventory for re-sale. The Fire Chief will need to check the storage area in the home for procedures on storage of chlorine.  A favorable motion for a Home Occupied Business Final contingent on the Price City Fire Chief’s review and recommendations of storage plans was made by Commissioner Shook. Commissioner Lyon seconded the motion.

 

V         CONDITIONAL USE PERMIT-SINGLE LOT SUBDIVISION-FINAL

            1560 E. SAGEWOOD RD.-ANTHONY BASSO, OWNER

Tom McCrary presented this request on behalf of Tony Basso. Due to a power line running through the property located at 1560 E. Sagewood Road a Single Lot Subdivision with a 15

 Easement needs to be requested. Years ago, the original owners lost the property to the bank. When the bank resold the property it was sold off into single sections without any zoning or subdivision approval of any kind. This lot does front a public street and meets zoning requirements with square footage and could be a legal lot. The other 3 sections of the lot will never receive a building permit because they are not legal lots. Currently there are no structures on the property and backs up to an existing fence. The power line runs through the property on an angle with a 25’ easement on either side of the power pole.  The only way to use the lot is to put a house in the front section of the property and use 15’ access for easement access.  Staff recommends this Single Lot Subdivision with a required 10’ public easement across frontage of property for public utilities access. All curb, gutter and sidewalk requirements have been met. Once this is approved, Mr. Basso will need to re-deed the property back to himself for approval to a legal lot then he can spell out the description of the easement on paper for this Single Lot Subdivision. The total frontage for this property is 115’. A favorable motion for a Conditional Use Permit Single Lot Subdivision Final with the provision for a 10’ easement on the north side of the property was made by Commissioner Lyon. Commissioner McEvoy seconded the motion. Motion Carried.

 

VI        CONDITIONAL USE PERMIT- KROMPEL SUBDIVISION-PHASE 1 AMENDMENT-CONCEPT-SAGEWOOD AREA-RICK KROMPEL, OWNER          

Rick Krompel presented this request. This amendment to Phase 1 is to add another 50’ onto existing lot #6 to have enough space to put a house on the properties. These lots already have an easement for utilities around the entire lot. All surrounding property owners must sign off on this outer description  to amend subdivision. If all owners sign off we don’t need a public hearing. Mr. Duzenack will research this Subdivision Amendment and the new state laws to verify this information and get back to Mr. Krompel to the exact way to proceed after concept. A favorable motion for a Conditional Use Permit Subdivision Amendment Concept Only was made by Commissioner Shook. Commissioner Richens seconded the motion.

 

VII      CONDITIONAL USE PERMIT- KROMPEL SUBDIVISION-PHASE 2-CONCEPT

            SAGEWOOD AREA-RICK KROMPEL,OWNER

Rick Krompel presented this request to open the road and tie the roads back together. The Parkway street will be opened which will leave 1550 East and 650 North to be named. Phase 2 is lot 10 through 20 known as Krompel Subdivision. Roads should all be developed with street improvements in accordance to the Land Development Code. The street improvements may not line up on all streets and will need to be evaluated by the City Engineer with a survey done on the entire area. A favorable motion for a Conditional Use Permit Subdivision Phase 2 Concept Only was made by Commissioner Richens. Commissioner Lyon seconded the motion.
