Due to the absence of Chairman John Angotti, Larry Bruno, Vice-Chairman conducted this  meeting.

 

 

1.                  MINUTES OF FEBRUARY 22, 2000

 

Joe Piccolo called attention to Item V - Conditional Use Permit - Business and Sign for Big T’s Gym, Paragraph 2, Lines 1-3.  He would like it corrected to read “Gary Lyon asked Mr. Mosteller if this was the first time he had heard about the sampling manhole. Mr. Mosteller indicated it was and that he has had no additional contact from PRWID at all.”  He feels this was Mr. Mosteller’s intent, but he had not received the letter from PRWID that the Commission had received.  The Commission’s concern is PRWID should be more prudent and timely in getting back to the applicants as well as the Planning and Zoning Commission.  There were no further corrections or additions and Gary Lyon made a motion to approve the minutes as amended.  Joe Piccolo seconded and the motion carried.

 

2.            HOME OCCUPIED BUSINESS - OFFICE USE ONLY

Mr. Behunin explained to the Commission he was interested in a Handyman License only and understands the limits of the license.  He will have no sign or inventory and will do his work on various job sites.  There were no concerns and Alfred Richens moved to forward a favorable recommendation to Price City Council for the Home Occupied Business  - Office Use Only - for Charles Behunin Handyman Service.  Gary Lyon seconded and the motion carried.

 

3.            CONDITIONAL USE PERMIT - AWNING

Mr. Morley was unable to attend this evening.  Mr. Duzenack explained the code requirements for the awning require an 8' clearance above the sidewalk with a maximum 7' overhang over the sidewalk.  In the original application, he planned to overhang the sidewalk 4' and is now considering a 6' overhang.  However, he is still within the requirements of the code.  Mr. Duzenack sees no other questions or concerns except for this one possible change to a 6' rather than a 4' awning and all other clearances can be met without any problem.  Joe Piccolo asked if the code calls for 8' to the metal frame with a 1' variation on the fringe.  Mr. Duzenack explained Mr. Morley can have a 1' fringe on the valance, but is only planning on a 6" valance and can make the 8' to the frame.  In addition, the Price City Attorney has reviewed the matter feels the liability exposure should not be much of a problem once the code is met.  As all concerns have been satisfied,  Joe Piccolo moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit for the awning at Wix Plaza as described.  Alfred Richens seconded and the motion carried.

 

4.            CONDITIONAL USE PERMIT - RESTAURANT REMODEL

RESTAURANT IN FORMER VIDEO VERN’S SPACE

PRICE PARTNERS I, LLC - MICHAEL NIELSEN

 

Mr. Nielsen was unable to attend and Mr. Richard Flack made the presentation.  He explained they would like to put a Chinese Restaurant in the former Video Vern’s Shop in Creekview Mall.  They are aware of the plumbing requirements and will install a new 6" sewer with grease trap and sampling manhole.  He has not indicated a sign on the Conditional Use Permit and told the Commission it is the tenant’s responsibility to do their signage and he will advise the tenant of such so they can return for approval of their sign.  He also told the Commission the reason the Castle Rock Café Building was not considered is they are negotiating with another tenant for the use of that building for a non restaurant use.  Their facility  will be a sit-down restaurant with private dining and will seat 150 to 200 people.  They will meet whatever building codes are required for the handicapped. Francis Duzenack indicated they are working on  their plans and the biggest change will be a commercial kitchen and full restrooms.  They have been in contact with PRWID.  Their application was uncomplete but more information will be forthcoming from the tenant.  There is ample parking around the restaurant area.  There were no further questions and Gary Lyon moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Restaurant Remodel at the Video Verns Building in Creekview Shopping Center.  Joe Piccolo seconded and the motion carried.

 

5.            STAFF - INFORMATION ONLY

 

1)                  Francis Duzenack referred the Commission to the copy of the final Rules of Procedure for the Planning Commission.  They have been reviewed by the Price City Attorney and approved by the Price City Council.  Commission Members should destroy all previous draft copies and keep the current copy for reference and review.

 

2)                  Mr. Duzenack has received a request from Price City Fire Chief Kent Boyack regarding the Chamber of Commerce sign.  If possible, he would like the sign to be relocated just one row of parking to the west.  He feels this move would open up the area around the Fire Station, allowing better access for his firemen when they are called out or having a meeting.

 


It will also give the public better visibility of the sign itself.  In talking with the Chamber, they like the new location and are in agreement with the move.  This item will be brought back to Planning and Zoning on the next agenda for further action.

 

3)                  INFORMATION ONLY - BASSO RV SALES

 

Francis Duzenack told the Commission Tony Basso will be leasing the

Hans Miller Property for RV sales.  This item will also be placed on the next agenda.

 

 

 

There was no further business and Alfred Richens made a motion to adjourn.  The meeting adjourned at 6:35 P.M.
