III. MINUTES OF MARCH 22, 2004
Gary Lyon suggested adding to item VII of the March 22, 2004 Planning and Zoning minutes, that Howard Pitts was strongly opposed. Gary then moved to approve the minutes as amended. Jeanne McEvoy seconded and the motion carried.
IV. HOME OCCUPIED BUSINESS - OFFICE USE ONLY

Mr. Atwood has been running this business out of Elmo and wishes to relocate to Price. The tools and equipment used for the jobs will be kept at the home but no employees will be working from the home. The employees will work at the job sites. Larry Bruno moved to forward a favorable recommendation to Price City Council for the home occupied business. Penny Sampinos seconded and the motion carried.

Ms. Blanton explained she has
three Persian cats she uses for breeding, one male and two female. They usually have four kittens per litter and
are sold before they are eight weeks old.
According to animal ordinances, three cats are allowed per home within
city limits and the kittens are allowed to remain in the home for up to six
months. All of the animals are kept
indoors. Gary Lyon moved to forward a
favorable recommendation for this home occupied business as long as she is in
compliance with the animal ordinances. Larry Bruno seconded and the motion carried.

Mr. Garff indicated there will be no inventory as the items are drop shipped from the distributor. No traffic will be generated. Alfred Richens moved to forward a favorable recommendation for this home occupied business. Penny Sampinos seconded and the motion carried.
VII. CONDITIONAL USE PERMIT - CHANGE OF USE

CHANGE FROM BUSINESS TO RESIDENTIAL RENTAL PROPERTY

It was explained the home has been in use as a preschool. The preschool is closing and the owners wish to use the home as a rental property. Penny Sampinos moved to forward a favorable recommendation for this change of use. Frankie Sacco seconded and the motion carried.
VIII. CONDITIONAL USE PERMIT - ABOVE GROUND POOL

Mr. Bridge stated the pool is 16' X 32' and 52" deep. It has a removable ladder and the yard has a 6' fence with a locking gate. Larry Bruno moved favorably to approve this above ground swimming pool. Gary Lyon seconded and the motion carried.
IX. CONDITIONAL USE PERMIT- BUSINESS AND SIGN

The manager of this facility, Amber Williams presented this item. A building inspection has been done and found some minor electrical work needs to be done along with reversing the doors and making an ADA ramp. There was a question concerning the volume of music that will be played. Ms. Williams stated the music will not be loud enough to affect neighboring businesses. There is adequate parking and the business will not be open on weekends. The sign is 3' X 9' and within limitations. Penny Sampinos made a favorable recommendation for this business and sign. Alfred Richens seconded and the motion carried.

X. CONDITIONAL USE PERMIT - BUSINESS AND SIGN

Mr. Martell explained he wishes to relocate his existing video store to this Main Street location. He will use the signs that are on the existing building and will mount them on a free standing frame as close to the road as possible on the fence line. Larry Bruno made a favorable recommendation for this business and sign. Gary Lyon seconded and the motion carried.
XI. CONDITIONAL USE PERMIT - CHANGE OF USE
OLD MAD PLATTER FROM RETAIL TO PROFESSIONAL OFFICE
690 WEST PRICE RIVER DRIVE
DR. SHANE TAYLOR, OWNER
Dr. Taylor stated his dental practice has outgrown the current facility and he wishes to relocate to 690 West Price River Drive. He told the Commission he also teaches scuba diving for College of Eastern Utah and the new building would be large enough to accommodate the dental office and a scuba store. He plans to build a wall to separate the two businesses and each will have its own entrance. In the shop he will sell scuba diving equipment and provide refills for oxygen tanks. He will also provide oxygen tank refills for the fire department, search and rescue and other agencies. The sign will be a copy change of the sign currently on the Mad Platter building. Gary Lyon moved to forward a favorable recommendation for this conditional use permit. Jeanne McEvoy seconded and the motion carried.
XII. STAFF
A. REVIEW OF CASTLE VALLEY LANDSCAPING
It was brought to the attention of Price City staff that Boyd Anderson was keeping several large temporary storage containers on the lot at 1480 East 800 North. These containers are not allowed by the Land Development Code and staff requested he have the containers removed within two weeks. He stated he plans to sell them or construct a building with them. He also stated he has applications to be on the next Planning and Zoning agenda explaining what he wishes to do with both the 1480 East 800 North property and the property on 400 West under the overpass. Francis explained Castle Valley Landscaping was originally approved as a home occupied business with a one year temporary use permit.

The temporary permit has expired and if he plans to build a building and run the business from the lot across from his home, he will need to get a conditional use permit. The Commission told Mr. Anderson they will wait to see the applications at the next meeting before deciding on an exact time when the temporary containers must be moved.
There was no further business and Gary Lyon moved to adjourn. The meeting was adjourned at 6:55 PM.
