Present: John Angotti (Chairman), Francis Duzenack (Zoning Administrator), Larry Bruno (Vice Chairman), Carolyn Vogrinec (Secretary), Laurel Marinos , Penny Sampinos, Gary Lyon, Alfred Richens, Joe Piccolo

Meeting convened at 6:00 P.M.


I. MINUTES OF MARCH 22, 1999

There were no corrections or additions and Larry Bruno made a motion to approve the minutes of March 22, 1999 as read. Gary Lyon seconded and the motion carried.


II. ALFRED RICHENS

RENEWAL OF TERM AS PLANNING COMMISSION MEMBER

Francis Duzenack indicated Alfred Richens term of office has expired. When asked if he wished to complete another term, Mr. Richens agreed to do so. A motion was made by John Angotti to present a recommendation to Price City Council to retain Alfred Richens as a Commission Member on the Price City Planning and Zoning Commission. Gary Lyon seconded and the motion carried.


III. CONDITIONAL USE PERMIT

HBR, INC. - 375 SOUTH CARBON AVENUE
HEALTH RESOURCE INFORMATION - PAUL SHEYA, M.D.

Dr. Sheya appeared before the Commission to explain the nature of his business. The business is located at the BTAC and is a resource center for health related businesses. There were no concerns and Larry Bruno moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit for HBR, Inc. Alfred Richens seconded and the motion carried.


IV. CONDITIONAL USE PERMIT

SIGN PRICE FLORAL - 44 WEST MAIN
STORE FRONT REVITALIZATION TO INCLUDE NEW SIGN - JACKIE DAVIS, PRESIDENT

Jackie Davis appeared before the Commission and presented a rendering of the proposed sign. It is a 8' x 32" facia sign and meets the regulations in the Price City Land Use Management and Development Code. The old brick on the building will be sandblasted and restored. A new awning will also be installed. There were no concerns and Alfred Richens moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Sign for Price Floral. Penny Sampinos seconded and the motion carried.


V. CONDITIONAL USE PERMIT

SIGN  - AZAR'S CARDIO - KICKBOX
253 EAST MAIN TERRANCE WOOD, PASTOR

Mr. Wood has not yet found a suitable building for his business and asked to be removed from the agenda.


VI. CONDITIONAL USE PERMIT

BUSINESS & SIGN - WADORYU KARATE SCHOOL
48 SOUTH 300 EAST - FORMERLY HARRIS STYLE SHOP
LARRY MARTINEZ, OWNER

Mr. Martinez explained that he had relocated his business to this new address. He uses only the front portion of the building. He will fasten his new sign to the old facia building sign already in place. Francis Duzenack indicated this is a copy change only for the sign. Mr. Duzenack, along with the Price City Fire Chief, would like to do a walk-through to check the wiring and condition of the building. There were no other concerns and Joe Piccolo moved to forward a favorable recommendation to Price City council for the Conditional Use Permit - Business and Sign for Wadoryu Karate School, contingent upon inspection of the building and wiring by the Price City Building Inspector and Price City Fire Chief. Gary Lyon seconded and the motion carried.


VII. CONDITIONAL USE PERMIT

BUSINESS AND SIGN -  THE BARBER SHOP AND PAPERBACK BOOK EXCHANGE
11 WEST MAIN - GARY JELSMA, OWNER

Mr. Jelsma explained that his business is now located in Wellington, but he will relocate in the Castle Valley Mall on the main floor. He will paint his business sign on the window and perhaps use the marquee sign on the building at a future date. He has a Wellington City Business License now, but will transfer the license over to Price City. Francis Duzenack indicated the Price City Building Official and Price City Fire Chief will want to inspect this building before it is open for business. There was no further discussion and Gary Lyon moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Business and the Sign as so stated, for The Barber Shop and Paperback Book Exchange, contingent upon inspection of the building by the Price City Building Official and the Price City Fire Chief. Laurel Marinos seconded and the motion carried.


VIII. CONDITIONAL USE PERMIT

REZONING AND ONE LOT SUBDIVISION
WITH PRIVATE DRIVE ZONE CHANGE FROM HC TO MR7
799 SOUTH FAIRGROUNDS ROAD - J. STEVEN CARLSON

Mr. Carlson appeared before the Commission to request the zone change and one lot subdivision. Francis Duzenack told the Commission that Mr. Carlson is planning a residential building lot and single family dwelling. Highway Commercial (HC) zones do not allow residential dwellings or apartments. The adjoining zone is a MR7 zone and this new property, when zoned MR7, will be adjacent to the adjoining MR7 zone. There is also a discrepancy on the measurements on the frontage of the property.  Mr. Carlson will have a new survey completed. There is also the matter of the street improvements. Currently, the street comes to his home and then angles off to the west. The triangular shaped piece of property in front of his home is owned by Price City. He is looking into the possibility of buying this property as he will need a formal right-of-way from Price City due to the creation of a new lot. Discussion was held on this matter. Francis Duzenack recommended the Commission approve the zoning and the subdivision of the lot and private drive. Mr. Carlson can then return for approval of the front property if Price City chooses to sell it. Following discussion, Larry Bruno moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit for the rezoning of 799 South Fairgrounds Road from HC to MR7 for a one-lot subdivision with private drive. Penny Sampinos seconded and the motion carried.


IX. CONDITIONAL USE PERMIT

PRELIMINARY AND FINAL - CEDAR HILLS STORAGE - PHASE II AND III
TONY BASSO AND BOBBY ETZEL, OWNERS

Mr. Basso and Mr. Etzel appeared before the Commission to present information concerning the additional work on their project. In Phase II, there are three more additional storage units to the north of the existing buildings, along with all the street improvements and widening of the road in front of that Phase. Part of the work is already completed; however, this project has previous Concept Approval. Francis Duzenack indicated that this is a continuation of Phase II and III and most street improvements are now in place. Curb and gutter goes to the driveway and stops at that point where the gutter cuts into the existing road. Gary Lyon asked about the 5% landscaping requirement, but actually 10% will be done. There were no other questions and Penny Sampinos moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Preliminary and Final for Cedar Hills Storage, Phases II and III. Gary Lyon seconded and the motion carried.


X. CONDITIONAL USE PERMIT

FILL WORK AND SITE PREPARATION - 828 EAST MAIN (BEHIND HOGI YOGI)

This applicant asked to be removed from the agenda and will return at a future date.


XI. CONDITIONAL USE PERMIT

PRELIMINARY AND FINAL - KENTUCKY FRIED CHICKEN/A&W
130 NORTH CARBONVILLE ROAD - ROGER HAMBLIN, AGENT

Roger Hamblin, representative for KFC/A&W, told the Commission the problem of the second drive has been resolved. They came back 50 feet as requested and installed another driveway leading out to Carbonville Road toward the east side. They will share the driveway with Taco Bell. The billboard sign will come down soon and all on-site work will be completed. The other driveway will be completed and shared with the tenant on the vacant ground. Francis Duzenack indicated that Price City Engineer Gary Sonntag had some comments for clarification of the plans. These were discussed at great length with Mr. Hamblin and he will provide what is needed to answer any questions or concerns. The sign is on the front of the building facing Carbonville Road. There is also a 8' x 14' pole sign on the back of the building and a menu sign. All signs meet the requirements of the Price City Land Use Management and Development Code. Seating capacity and parking is also in line. There were no further concerns and Joe Piccolo moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Preliminary and Final for Kentucky Fried Chicken/A & W. Larry Bruno seconded and the motion carried.


XII. CONDITIONAL USE PERMIT

CONCEPT - R. KROMPEL COMPANY - SAGEWOOD SUBDIVISION
1390 EAST SAGEWOOD ROAD - THREE PHASE SUBDIVISION AND PLANNED UNIT DEVELOPMENT

Rick Krompel appeared before the Commission to explain plans for his Three Phase Subdivision and Planned Unit Development. He plans to do the first phase, and would like Concept Approval for this portion. Joe Piccolo expressed his concern with the two dead end streets included in this plan and the general traffic flow through the subdivision. Not all street lights, fire hydrants, curb, gutter or sidewalk are in place. The lots run approximately 60' x 100' square feet, depending on the layout of the subdivision and this meets the size requirement. Discussion was held on these matters. Gary Lyon asked about the possibility of soil settlement in that area and what, if anything, is Price City doing about that concern. Francis Duzenack indicated that Price City now requires a soil evaluation for every subdivision. Gary Lyon asked if there were any concerns with this project and Mr. Duzenack indicated he had no concerns at this point, but the preliminary and final plans would show more detail. While Mr. Krompel is asking for Concept Approval of Phase I only, Joe Piccolo told the Commission that he felt Concept Approval should be given for the entire project due to the plan cost involved. Approval could then be given to each phase of development as it comes before the Commission. After all concerns had been answered, Joe Piccolo moved to forward a favorable recommendation for the Conditional Use Permit - Concept Approval - to the R. Krompel Company - Sagewood Subdivision, with the contingency that Mr. Krompel proceed with Preliminary and Final drawings of Phase I as requested and present them to the Commission for approval. Alfred Richens seconded and the motion carried.


XIII. STAFF

A) 1999 CITIZEN PLANNER GUIDE TO SUBDIVISION DEVELOPMENT
Francis Duzenack referred the Commission to the above publication for referral and information.

B) Joe Piccolo asked why all Commission terms expired at the same time. Francis Duzenack explained this happened as a result of members being appointed to serve uncompleted terms. The dates of installation became mixed up with the dates of the terms. He will look at this situation, determine the length of the term and stagger them so the Commission will not be without experienced people. Mr. Piccolo suggested Price City Recorder Joanne Lessar be contacted for the correct dates of expiration.
