A favorable motion to approve the minutes of April 9, 2007 as read was made by Commissioner Sampinos. Commissioner Shook seconded the motion. Motion carried.

 

IV           HOME OCCUPIED PERMIT – AMENDMENT – FINAL

                239 NORTH 400 WEST – STONE TOAD WATERSCAPES AND LANDSCAPING-LYLE BAUER, OWNER

Lyle Bauer presented a request for an amendment to a Home Occupied Permit (HOB) for the business of Stone Toad Waterscapes and Landscaping, LLC currently located at 239 N. 400 West. Mr. Bauer’s family owns the home located at 412 West 200 North (directly south of Mr. Bauer’s residence) as an unoccupied rental property. In order to facilitate off street parking for the work vehicles, Mr. Bauer is requesting an amendment to his HOB permit to include use of the rental property.  Mr. Bauer stated that he currently has a flatbed utility trailer with a backhoe attached; a trailer with a mortar mixer for curbing; a 6-ton dump truck, and a 6-ton flatbed truck parked at the rental property as well as some product. This issue has been brought to the attention of Price City by a citizen complaint. He has a letter of approval from the family allowing him to use the property to park his vehicles.  The Commissioners are concerned because of the citizen complaint and the impact this HOB may be having on the neighborhood. When Mr. Bauer received the HOB permit originally, there were to be no supplies, equipment or vehicles stored on the property. Mr. Bauer did not foresee any of the issues that are now causing a problem and would like to make sure he complies with the requirements of his HOB.  Staff recommends the use of the property for off street parking of non-equipment (back hoes) vehicles unless the property is rented out for residential use. Mr. Bauer should also be reminded of the stipulations regarding HOB uses:

·         Limitations on storage of supplies and inventory

·         Maintenance and parking of equipment nor harmonious with the surrounding neighborhood

·         Limitations of on-street parking

·         Limitations on assembly of employees

·         Signage restrictions

MOTION. A favorable motion was made by Commissioner Shook to amend the Home Occupied Use Permit to allow a temporary use of the property for 120 days until arrangements can be made for all vehicles, equipment and inventory storage. And to waive the amendment fee of $60.00 since the amendment was proposed, recommended and initiated by Price City. Motion seconded by Commissioner Lyon and carried.

 

V             HOME OCCUPIED PERMIT – BUSINESS – OFFICE USE ONLY – FINAL

                883 MOLYNEUX DRIVE – DUNN PLUMBING – KEVIN DUNN, OWNER

Kevin Dunn presented a request for a Home Occupied Business (HOB) Office Use Only permit. Mr. Dunn’s business will consist of a vehicle parked in the garage with supplies and equipment on the truck only.  He will not have employees or traffic coming to his home. There will not be an impactanticipated to the neighborhood. Staff recommends approval as presented. MOTION. A favorable motion was made by Commissioner Lyon to approve the Home Occupied Use Office Use Only permit. Motion seconded by Commissioner Richens and carried.

 

VI           CONDITIONAL USE PERMIT – BUSINESS – FINAL

                90 WEST 100 NORTH – CHRIS’ HAIR DESIGN – CHRIS MICOZ, OWNER

Chris Micoz presented a request for a Conditional Use (CUP) Business and Sign permit for her hair salon. Ms. Micoz has had a business license in Price City for 10 years.  The building is located at 90 West 100 North and has adequate parking. The Building Inspector has inspected the location and recommends two GFI breakers and an ADA ramp be installed to facilitate the business. There will not be a sign for this business other than a sticker decal sign on the windows or the door. An appointment has been set for the Fire Inspector. MOTION. A favorable motion was made by Commissioner Richens to approve the Conditional Use Permit Business Final for Chris’ Hair Design. Motion seconded by Commissioner Lyon and carried.

 

VII          CONDITIONAL USE PERMIT – LAND SUBDIVISION – FINAL

                1481 EAST NELSON LANE (150 SOUTH) – PRICE SENIOR HOUSING, COMMUNITY HOUSING

Community Housing Services has received approval for the development of a senior housing complex at 1481 East Nelson Lane (150 South). While the development of the project has been provided with final approval, that approval was contingent upon the completion of the land subdivision for the project.  The land to be subdivided is currently owned by Scott Nelson and is situated within a CD zone, no zoning changes or amendments are necessary for the approval of the subdivision. The final approval will allow the project to proceed with actual land acquisition and commencement of the construction. The action(s) requested are allowable under Section 11.3.2.1.5 (group homes) and Section 11.3.11.1 (subdivisions) of the Price City Land Use Management and Development Code. MOTION. A favorable motion was made by Commissioner Shook to approve the land subdivision Conditional Use Permit and requirement of deeding of the public right-of-way to Price City. Motion seconded by Commissioner Nielson and carried.

Commissioner Lyon motioned to adjourn. The meeting adjourned at 6:55 P.M.
