thanked Larry Bruno for presiding over the previous meeting in his absence.

MINUTES OF APRIL 24, 2000
Alfred Richens indicated an
addition to the minutes. Joe Piccolo
should be shown as excused from this meeting . Gary Lyon made a motion
to approve the minutes of April 24, 2000 as amended. Laurel Marinos seconded and the motion carried. As Mr. Piccolo was not in attendance for
this meeting, he proffered a No vote.

Karen Dunn explained to the
Commission that she will be doing 24 hour daycare. Joe Piccolo asked if 100% of her home will be used in care of
children. Ms. Dunn said she will need
the use of her entire home in order to do the job.
There was some discussion on the
matter and Vern Jones indicated he will check on whether or not the entire
house can be accessed by the business.
This will be done prior to the next City Council Meeting. Ms Dunn will be licensed by the State of
Utah and has all the required permits and complied with all inspections. The Price City Fire Chief has toured the
home and finds it satisfactory.
Included in this application are five favorable signatures from
surrounding neighbors for 24 hour daycare.
There were no further concerns and Joe Piccolo moved to forward a
favorable recommendation to Price City Council for the Home Occupied Business
of Karen Dunn Daycare, contingent upon the Utah State License and Price City
Business License being enforce before operation begins. Penny Sampinos seconded and the motion
carried.

PET CARE AND CRAFT ITEMS

Ms. Hayes explained everything
will be done off site at the client’s home and her nephew will help with the
pet service. This service is for people
who do not want to board their animals when they are away. No inventory is stored for the pet
services. There will be some inventory
stored for crafts, but will be used for
craft boutiques and shows. Because Ms. Hayes may have inventory, there was some
discussion on whether or not she should apply for a regular business
license. However, she is not
warehousing and has only a small inventory three or four times a year for craft
shows and it was decided to go with the Home Occupied Business. There were no further concerns and Larry
Bruno moved to forward a favorable recommendation to Price City Council for the
Home Occupied Business - Office Use Only for the Business of Pet Care and Craft
Items - Suzanne Hayes. Gary Lyon
seconded and the motion carried.

Mr. Fausett indicated he will do
carpet cleaning and has no plans for a sign.
He was asked to indicate so on his application and initial the
entry. Mr. Fausett complied with this
request. Vehicle carpet cleaning will
be done at his home or on site. The
portable equipment is on one vehicle so it can be used in the home also. The chemicals are water soluble and are
disposed at the chemical dump. There
were no other questions and Alfred Richens moved to forward a favorable
recommendation to Price City Council for the Home Occupied Business - Office
Use Only for Dirt Terminator. Penny

5.

Ms. Mendel presented a diagram of
the seven four foot signs being placed within Price City Limits and a list of
their locations. The signs will be placed
on dirt and staked to the ground on opposite corners to reduce the chance of
tipping. The ten foot signs will be
used only at locations in the County.
They also asked for permission to use hay bales and cowboy dummies on
various key spots during the rodeo week.
Local volunteers will check and maintain these items every other
day. Names of the volunteers will be
filed with Price City in the event of any problems. They are Vickie Noyes - Kathy Hanna - Melaine Mainord & Don
Reaveley. There were no concerns and
Larry Bruno moved to forward a favorable recommendation to Price City Council
for the use of Temporary A-Frame Signs
for Black Diamond Stampede. Laurel
Marinos seconded and the motion carried.
6.
RE-ZONE REQUEST

RE-ZONING OF PROPERTY FROM RR TO

Mr. Serfino Nick came before the
Commission concerning this re-zoning request giving a short history of the Nick
property. It is split into four parcels
and Nick Lane divides the property into three pieces. The property was annexed by Price City in August of 1987 and Mr.
Nick assumed the entire property was zoned Residential. While trying to obtain a Building Permit, he
found a portion of his property is still zoned Rural Residential. He would now like to put a house on this
property, but the zoning will not allow it.
He is requesting the property be re-zoned MR-7. Following some discussion on the matter, Joe
Piccolo made a motion to forward a recommendation to Price City Council to
provide a PublicHearing for this Re-zoning Request. Alfred Richens seconded and the motion carried.
7. CONDITIONAL

PRICE V LLC - OFFICE BUILDING

Rich Morley, of M-13 Construction
told the Commission the building will locate next to the Forest Service and
across from the BLM Buildings and will house the State of Utah Department of
Motor Vehicles, the only tenant at this time.
The plans for this project have been reviewed by Staff, but there are
some changes and updates have been made.
Sewer and water have been addressed, but the sampling manhole is still
in question. They have met with PRWID
and provided a new site plan showing the new sampling manhole. A letter from PRWID concerning these changes
will be forthcoming. Mr. Piccolo asked
if the problem of the irrigation ditch running along their property has been
addressed. Originally, the building was
to be built over the ditch and the ditch relocated. However, Mr. Duzenack suggested they move the building forward
ten feet as there is room enough in the setbacks. The site plans were re-drawn and the building was sited ten feet
forward. Now, there is no longer any
interference with the irrigation.
However, when they moved the ten feet, they did not pull the trash
receptacle out of the easement. The
corner still sits within the easement and this must be addressed. Mr. Piccolo asked about the storm water
run-off from the property. Mr. Morley
indicated this site is elevated and does not sit in a valley. A storm drainage plan was submitted and
since no feedback was given on the matter, they assumed it was acceptable. It shows the water coming to the street and
into the existing storm drain system.
Mr. Duzenack has reviewed it and finds it satisfactory.
Francis Duzenack has requested the
Army Corp of Engineers review the west end of the site for wetlands. An engineer will be make the evaluation and,
if it is a wetlands area and they cannot mitigate the issue, there is enough
property to adjust the site to the east.
Mr. Jones asked concerning the easement for the existing driveway. Mr. Morley indicated the driveway shown on
the current plan shows the easement running right through the parking lot and
they will maintain that easement. If
the building is shifted to the east, they will re-visit the easement
maintenance. It is not a recorded
easement, but a courtesy easement and, in speaking with the State DFCM
personnel concerning that matter, they were told it could be worked out and
would not be an issue.
Each building level has 4000 square feet. The DMV will use a large portion of one
level. Mr. Morley explained there is
adequate parking for the facility because there are two lots, Lots 4 & 5
and, Lot #4, to the east, will be left as an unbuildable lot to be used as additional
parking if needed. Joe Piccolo asked
what level of Conditional Use Permit is being requested tonight. Mr. Morley requested Final Approval. Even though every building in this zone
requires a Conditional Use Permit, the State of Utah is urgently pursuing this
project in order to get the DMV out of their current location and into the new
building by June 1. They contacted the
Building Department to see if there was some way to speed up the process. DFCM was told if everything was completed
perfectly, there would be a chance for a Final Approval. However, because there are some items not
yet done, Commission Members cannot grant Final Approval tonight, but will
support Preliminary Approval on the matter.
Larry Bruno then moved to forward a favorable recommendation to Price
City Council for the Conditional Use Permit - Preliminary Approval for
Price V LLC - Office Building (DMV, Price River Drive Business Park, Lot
#5). Gary Lyon seconded and the motion
carried.
8. CONDITIONAL
USE PERMIT - FINAL
McDONALDS CORPORATION
RELOCATION OF McDONALDS

Mr. Eskelson and Mr. Bishop came
before the Commission for Final Approval for McDonald’s Restaurant. Larry Bruno referenced the waste water
survey letter from PRWID. There are several items to be addressed and Mr.
Eskelson will contact PRWID to resolve these issues and have the drawings
changed. Vern Jones asked if they had
received the estimate on the relocation of the power lines and still wanted to
proceed as presented. Mr. Bishop told
the Commission the power situation is unacceptable as it is, but the price
quoted, $30,962.00, for the moving of three power poles, is also unacceptable. There is no breakdown on costs in the quote
and they would like to see the job done on time and materials. They will proceed as planned, but want it
known the quoted amount is a ridiculous price.
Joe Piccolo asked if, when they do business elsewhere, are poles moved
for less money. Mr. Bishop indicated
that, in most other places, they are been moved for nothing. Mr. Piccolo asked for documentation on these
instances so some pressure may be applied.
He feels that if a utility makes it prohibitive to deal with businesses
within Price City Limits, whereas in other areas, it is not that way, then
perhaps it warrants some review and asked for a copy of the quote. There were no further concerns or questions
and Penny Sampinos moved to forward a favorable recommendation to Price City
Council for the Conditional Use Permit - Final Approval for McDonalds
Corporation, contingent upon receipt of a letter from PRWID indicating
compliance with all pre-treatment requirements. Gary Lyon seconded and the motion carried.
9.

PRESENTATION OF INFORMATION
CONCERNING
AWNING AND SIGN BY MR. HOFFMAN
Paul Hoffman explained they are
planning to move their business to the above address and are working with Tony
Basso. He presented plans for changes,
but this is not their final plan, just a proposed idea. They will paint the exterior of the
building, do maintenance to bring the building up to code, and do some front
landscaping. They will not use the
basement. They want to draw attention
to the main street entrance and close up the southwest door. The signs will be
brought up to grade and meet all codes.
There will be no other building sign other than on the northwest
corner. They will utilize the entire
building and Sherry’s Body Shop will move to the adjacent laundry, allowing
them to use that part of the building as warehouse space. Reference was made to
the letter from PRWID concerning the waste water survey. Mr. Richens recommends the installation of a
6" sewer lateral with a sampling manhole for the store. Joe Piccolo mentioned a pre-treatment
facility would be needed in the laundry building as there is not anything
updated in place. Mr. Hoffman has not received any information from PRWID
concerning these improvements and will contact them for more information. Following discussion on this matter, Joe
Piccolo moved to forward a favorable recommendation to Price City Council for
the Conditional Use Permit for Relocation of Hard Hat Furniture and Appliance
to 301 East Main. Larry Bruno seconded
and the motion carried.
10.

Mr. Basso was unable to attend due
to a death in his family. Gary Lyon
made a motion to table this item and place it on the next meeting agenda. Joe Piccolo seconded and the motion carried.
11.
CONDITIONAL USE PERMIT
REQUEST TO FILL AND COVER DRAINAGE

Mr. Santi explained these pipes
have been in place and extended for 15 years.
This is a request to cover over the remaining pipes with the dirt on the
property. He has met with Price City
Assistant Engineer Jerry Wright and the project was approved. The water is
seepage from Meads Wash and goes in the pipe under the road. There are clean-outs every 300 feet. “No Dumping” signs will be posted by the
Checker Auto Store Property. This will
complete his project. There were no concerns and Penny Sampinos moved to
forward a favorable recommendation to Price City Council for the Conditional
Use Permit for a Request to Fill and Cover Drainage Pipe at approximately 1100
East Main. Laurel Marinos seconded and
the motion carried.

STAFF

Alfred Richens asked that Francis Duzenack look into A-1
Rental at 190 South Carbon Avenue. They
are parking much of their equipment on Price City property, the parkway between
the sidewalk and the gutter. It cuts
down on the visibility for those who use 200 South coming onto Carbon
Avenue. In order to see around the
equipment, you must pull out onto the street, posing a danger. Mr. Jones suggested this be turned over to
the Price City Police Chief.
There was no further business and Alfred Richens made a
motion to adjourn.
