Mayor Colosimo led the Pledge of Allegiance. Roll was called with the above members in attendance.


1. MINUTES - May 1, 1997 MOTION. Councilmember Wheeler moved that the minutes of the May 1, 1997 meeting be approved as written. Motion seconded by Councilmember Denison and carried.

2. MINUTES - May 14, 1997 MOTION. Councilmember Denison moved that the minutes of the May 14, 1997 meeting be approved as written. Motion seconded by Councilmember Wheeler and carried.

3. BID OPENING - Street Light Poles and Street Lights - Committee Appointed

The following bids were received for street light poles and street lights:

QED, Murray, Utah $10,200.00

Codale Electric Supply, Price $ 9,583.33

Royal Wholesale Electric, Orem $ 9,331.00

MOTION. Councilmember Piccolo moved that a committee consisting of himself, Councilmember Nikas, Gary Kutkas, Pat Larsen, Gary Sonntag, and Vern Jones, be appointed to review the bids and given the power to act. Motion seconded by Councilmember Wheeler and carried.

4. INTRODUCTION OF NEW BUILDING INSPECTOR - Robert Bennett.  Francis Duzenack introduced Robert Bennett, the new Building Inspector. The Council welcomed Mr. Bennett to the City.

5. GOOD SAM CLUB - Rental Fees Waived For Civic Auditorium.

MOTION. With the exception of hard costs, Councilmember Wheeler moved that rental fees be waived for use of the Civic Auditorium for a Good Sam Club convention to be held September 11th. Motion seconded by Councilmember Bringhurst and carried.

6. SCOFIELD PLEASANT VALLEY DAYS - Contribution Approved

MOTION. Councilmember Denison moved that $100 plus 50 wave pool passes be contributed to the Scofield Pleasant Valley Days. Motion seconded by Councilmember Piccolo and carried.

7. CARBON COUNTY FAIR AND INTERNATIONAL DAYS - Program Ad

MOTION. Councilmember Piccolo moved that the City purchase a full page ad in the Sun Advocate in the amount of $351 for the Carbon County Fair and International Days edition. Motion seconded by Councilmember Wheeler and carried. It was recommended to place two coupons in the ad for redemption at the wave pool.

8. LANE MILLER - Request For Speed Bump On Smith Drive - Committee Appointed

Lane Miller presented a petition from residents living on Smith Drive requesting that a speed bump be placed on their street. There is a dip in the road on Wadleigh Lane, and as cars come down Smith Drive and onto Wadleigh Lane, they hit the dip. Sparks actually fly from underneath the cars. It is a safety concern as there are over 30 kids who live in this area. Several ways to eliminate the problem was discussed. MOTION. Councilmember Piccolo moved that a committee consisting of Councilmember Nikas as Chairman, Chief Shilaos, Vern Jones, Gary Sonntag, Cobb Johnson, and residents Lane Miller and Jim McPhie, be appointed to review this problem and make a recommendation to the Council. Motion seconded by Councilmember Wheeler and carried.

9. KIWANIS FIRE WORKS DISPLAY - Contribution Approved

MOTION. Councilmember Piccolo moved that $600 be contributed to the Kiwanis Club for the annual fireworks display. Motion seconded by Councilmember Wheeler and carried.

10. GOLDEN DRAGON FIREWORKS, NAILED BY NIKI - Home Occupied Businesses.  Councilmember Piccolo reported that the Planning and Zoning Commission gave a favorable recommendation to the following home occupied businesses:

Golden Dragon Fireworks - Barry L. Cook-Owner, 759 North 100 East (subject to no storage of fireworks)

Nailed By Niki - Niki Guzman-Owner, 224 North 100 West

MOTION. Councilmember Piccolo moved that the home occupied businesses be approved upon payment of the business license fee and that there be no storage of fireworks on Mr. Cook's residential property. Motion seconded by Councilmember Bringhurst and carried.

11. BLACKHAWK ENGINEERING, HOLIDAY INN, H & R THERMO-VAC, WHITMORE OXYGEN, MORTENSEN'S CARPETS, CIRCLE K RANCH - Conditional Use Permits

Councilmember Piccolo reported that the Planning and Zoning Commission gave a favorable recommendation to the following requests for Conditional Use Permits:

Blackhawk Engineering - 214 East 100 North, Sign

Holiday Inn - 838 Westwood Blvd., Sign

H & R Thermo-Vac - Relocation of Existing Business, 1695 East 1000 South

Whitmore Oxygen - Relocation of Existing Business, 79 North Carbon Avenue

Mortensen's Carpets - Relocation of Existing Business, 78 North Carbon Avenue

Circle K Ranch - Self Storage Facility, 850 South Carbon Avenue (Behind Market Express)

MOTION. Councilmember Piccolo moved that the requests be approved and that Conditional Use Permits be issued. Motion seconded by Councilmember Denison and carried.

12. RESOLUTION #97-08 - Adoption of Budget For FY1997/98

MOTION. Councilmember Piccolo moved that Resolution #97-08, adopting the Budget for FY1997/98, be approved and that the Mayor and City Recorder be authorized to sign the resolution. Motion seconded by Councilmember Denison and carried.

13. TRAVEL REQUEST - Scott Olsen, Kevin Mele, Utah Peace Officer's Association Police Combat Pistol Match, June 18, Delta

Mayor Colosimo recommended that Scott Olsen and Kevin Mele be authorized to attend the Utah Peace Officer's Association Police Combat Pistol Match in Delta, Utah, June 18. MOTION. Councilmember Wheeler moved that the travel be approved. Motion seconded by Councilmember Piccolo and carried.

14. PERMISSION TO ADVERTISE FOR CROSSING GUARDS, WATER MASTER, AND PBX OPERATOR

PERMISSION TO HIRE FOUR TEMPORARY EMPLOYEES FOR STREETS & MAINTENANCE

Mayor Colosimo presented the following personnel requests and recommended approval:

Permission To Advertise For Part Time Crossing Guards

Permission To Hire Four Temporary Employees For Streets and Maintenance

Permission To Advertise For Permanent/FT Water Master

Permission To Advertise For Permanent/FT PBX Operator

MOTION. Councilmember Piccolo moved that the personnel requests be approved. Motion seconded by Councilmember Wheeler and carried.

15. CITY PROPERTY LOCATED 2ND SOUTH BETWEEN 5TH & 6TH EAST - Permission To Advertise For Sale

Vern Jones reported that the City owns a parcel of property on 2nd South between 5th and 6th East. Approximately two years ago, an organization expressed interest in purchasing this property and an appraisal was conducted. The property was advertised for bid, but there was no response. He recently was contacted by two individuals expressing an interest to purchase the same property. He requested direction from the Council whether they want to sell the property, and if so, if they want another appraisal. MOTION. Councilmember Bringhurst moved that Mr. Jones be directed to contact the appraiser for an update on the property value and that the property be advertised for sale for the appraised value plus the appraisal fee. Motion seconded by Councilmember Denison and carried.

16. ORDINANCE #97-002 - Parking Enforcement For Oversized Vehicles

Nick Sampinos presented Ordinance #97-002, repealing Sections 10.16.010 through 10.16.040, inclusive of the Price Municipal Code, 1988, as amended, and adding thereto, Sections 10.40.211 through 10.40.214, prohibiting the parking of abandoned, inoperative, or oversized trailers, motor homes, machinery, boats, vehicles, or other unauthorized objects on streets, alleys, or public right-of-ways within Price City and providing for time restrictions and oversized vehicle restrictions and setting forth an enforcement procedure by civil process, effective upon publication. MOTION. Councilmember Piccolo moved that Ordinance #97-002 be adopted, that the Mayor and City Recorder be authorized to execute the ordinance, and that it become effective upon publication. Motion seconded by Councilmember Denison and carried.

17. ORDINANCE #97-003 - Municipal Energy Sales and Use Tax

Nick Sampinos presented Ordinance #97-003, creating a Municipal Energy Sales and Use Tax, effective July 1, 1997. MOTION. Councilmember Denison moved that Ordinance #97-003 be adopted, that the Mayor and City Recorder be authorized to execute the ordinance, and that it be published. Motion seconded by Councilmember Bringhurst and carried.

18. ORDINANCE #97-004 - Transient Room Tax

Nick Sampinos presented Ordinance #97-004, establishing a transient room tax on rents charged to transients occupying public accommodations within Price City and setting forth the procedure for collection thereof, effective July 1, 1997. MOTION. Councilmember Bringhurst moved that Ordinance #97-004 be adopted, that the Mayor and City Recorder be authorized to execute the ordinance, and that it be published. Motion seconded by Councilmember Wheeler and carried.

19. WATER EXPANSION PROJECT - CRS Consulting Engineers - Partial Payment (Tank)

Gary Sonntag presented a request from CRS Engineers for a partial payment in the amount of $5,186.28 for work completed to date on the 10 million gallon water tank. They also submitted a request for a partial payment in the amount of $1,585 for work on the pumps, pipeline and telemetry. Councilmember Piccolo questioned the extreme delay in the project. The tanks are still not on line, and as there are problems in the pumphouse that are related to engineering, he wants to be sure there are sufficient funds withheld until the system is on line and running properly. MOTION. Councilmember Piccolo moved that the payment in the amount of $5,186.28 be paid and that the $1,585 be withheld. Motion seconded by Councilmember Wheeler and carried.

20. KIAHTIPES CARBONVILLE WATERLINE RELOCATION - Partial Release of Letter of Credit - Struck

21. PRICE COMMUNITY CENTER - Rental Contracts With Price River Water Users Association and Carbon County Historical Society

Vern Jones presented contracts submitted by the Price River Water Users Association and Carbon County Historical Society for room rental in the Price Community Center. He requested that they be approved and executed. MOTION. Councilmember Bringhurst moved that the contract be approved and that the Mayor and City Recorder be authorized to execute the documents. Motion seconded by Councilmember Wheeler and carried.

22. CLADDING OF DOMES - Contract Awarded

Councilmember Wheeler reported that a meeting was held earlier today to discuss cladding of the domes. The committee recommended that ACM, Layton, Utah, be awarded the contract. MOTION. Councilmember Wheeler moved that ACM be awarded the contract for cladding of the domes in the amount of $131,379. Motion seconded by Councilmember Bringhurst and carried.

MOTION. Councilmember Piccolo moved that the meeting adjourn and that a meeting of the Redevelopment Agency convene. Motion seconded by Councilmember Bringhurst and carried.
