MINUTES OF JUNE 20, 2005

A motion was made to appoint Gary Lyon to Pro tem Chairman by Alfred Richens. Jeanne McEvoy seconded the motion. Motion Carried.

III        MINUTES OF JUNE 6, 2005

A favorable motion to approve the minutes of June 6th, 2005 as amended was made by Alfred Richens. Frankie Sacco seconded the motion. Motion Carried.

 

IV        CONDITIONAL USE PERMIT- BUSINESS AND SIGN FINAL

            LITTLE MUDD, 1475 AIRPORT ROAD-JEDD MORLEY, PRESIDENT

            Jedd Morley presented this request. He would like to start a concrete manufacturing business using a U-cart facility. There will be a pile of sand and a pile of gravel for use with this business located on the airport road property. Dust control will be handled with the wetting of the piles as needed with the high winds in order to protect surrounded residential home and businesses. The business would have hours from 8a.m. to 5 p.m. unless business called for an after hours job. The commissioners felt the hours were acceptable daily hours when neighbors were awake or working. The machine used would be a 20-horse power engine mixer with an approximate 40 ton of concrete at a time. Staff would like to see a fence placed around the east and south sections of the property to contain the noise and possibly keep the dust down. The Land Development Code requires a sight obscuring fence. Mr. Morley will dig a drain hole for the cleanup of tools and the machine and periodically haul the remains to the landfill. Drainage on the property will need to be looked at as the property takes shape. As far as Mr. Morley is aware, there will be no additional pavement added to the property. A section of the road will be paved by county (easement) on the east side. Mr. Morley would like to add a sign by the edge of the road, high enough to see from the road on a post. He did not have any information with him on this matter. Mr. Richens told him to come back to the meeting on another day to discuss the sign size and placement. The property has always been commercial property (CD) and now listed as MD/MG industrial and was meant for this type of business in the area. As long as the impacts are minimal there shouldn’t be a problem. The commission would like to award Mr. Morley with a temporary permit for one year in order to evaluate the conditions and the effects it may have on the surroundings. Mr. Morley would like to begin the business as soon as possible. The sign size and placement will need to be addressed at another meeting. The business will need to be re-evaluated one year from today. A favorable motion for a Temporary Conditional Use Permit for “Little Mudd” for one year contingent on a fence addition near south and east side of the business was made by Alfred Richens. Frankie Sacco seconded the favorable motion. Motion Carried.

 

V         CONDITIONAL USE PERMIT- BUSINESS & SIGN FINAL

            EXTREME AUTOMOTIVE, 528 SOUTH HIGHWAY-PAUL SIMMONS, OWNER

Paul Simmons presented this request. This is an existing small business in Emery County relocating their business to Zupon’s Body & Paint Shop in Price. Mr. Simmons will have a lease with Mr. Zupon and a copy change on the name of the existing signs to continue with the same type of business.  Extreme Automotive will do body and fender work, installation of lift kits, computer chips and retail accessories. This will not be a mechanic shop. A favorable motion for a Conditional Use Permit and Copy Change Sign Final for Extreme Automotive was made by Frankie Sacco.  Alfred Richens seconded the motion. Motion Carried.

 

VI        CONDITIONAL USE PERMIT- SHED-FINAL

            USDA/NRCS-WAYNE GREENHALGH, REPRESENTATIVE

            Wayne Greenhalgh presented this request. USDA would like to add a shed onto the northeast   corner of USDA property (in the back of the unused parking lot). This will be a 16x20 storage shed to store soil samples, 4 wheelers and office equipment. This will be stick built and addressed out with the builder to meet code. The shed will be on skids in order take it with them if they ever        had to   move. Staff was satisfied with this project. A favorable motion for a Conditional Use Permit Shed Final by Alfred Richens. Seconded by Frankie Sacco. Motion Carried.

 

VII      CONDITIONAL USE PERMIT-SUBDIVISION FINAL

            JON ANAST, OWNER- 3RD EAST 2ND SOUTH

Francis Duzenack presented this project. Jon Anast would like to divide this lot located on the corner of 2nd S. and 3rd E. into three separate lots. There is a house located on the corner section that will be sold with one lot to the north and one to the west of the house. All of the zone requirements have been met to create a 3 lot division. Staff has discovered that the paving in front of the home is only completed down the middle of the street and both sides are gravel. Jon Anast will be responsible for the asphalt completion at his own expense.  It is an approximate 10 foot strip and he would only be accountable at this time to complete the asphalt in front of the house. Completing the asphalt in front of the empty lots would not be valuable at this time due to sewer and water installation if the property is ever sold. This is a nice size property at almost a quarter of a block. The old home has been completely improved. The curb, gutter and sidewalk are already in place. A favorable motion was made by Frankie Sacco for this Conditional Use Permit 3-lot subdivision Final for Jon Anast contingent on new asphalt in place at owner’s expense. Alfred Richens seconded the motion. Motion Carried.

 

VIII     CONDITIONAL USE PERMIT-ANNEXATION FINAL

            PROPOSED PUBLIC FACILITIES-PRICE NORTH 2005 ANNEXATION

            910 NORTH 700 EAST-GARY SONNTAG-PUBLIC WORKS DIRECTOR

Francis Duzenack presented this request. Price City is submitting a petition for annexation into Price City 35.46 acres of unincorporated land, situated and contiguous to the existing northern Price City boundary. Said property is located in the Southeast Quarter of Section 9 and the Southwest Quarter of Section 10, T14S, R10E, SLB&M. To incorporate city properties into the city limits and provide a means for the city to control land use development and management of properties and land that impacts the city.  Building will be remodeled with offices for use by various departments within the City. A Public Hearing has been set in motion for this annexation. A favorable motion was made by Alfred Richens for this Conditional Use Permit Annexation. Jeanne McEvoy seconded the motion. Motion Carried.

 

IX        CONDITIONAL USE PERMIT-CONCEPT ONLY

            PROPOSED CONSTRUCTION OF GOVERNMENT LEASE BUILDINGS

            PRICE RIVER DRIVE BUSINESS PARK-RAY MORLEY, OWNER

            Ray Morley presented this request. This is a concept only proposal for future development. This development is located in the Price River Drive Business Park cul-de-sac. Mr. Morley’s development would include completion of the business subdivision by adding one more lot just east of the USDA Building.  Two additional buildings would be added at the end of the cul-de-sac to complete the subdivision.  This addition would clean up the area with weed control and unsightly trees and garbage, while completing the Business Park.  Mr. Morley is seeking a concept approval on the site plan handed in to the commission. There would be plenty of parking spaces with 225 spaces and 20 for the small building east of USDA. A zone change for two lots would be necessary because it does not meet the minimum ¾ acre requirement for a CD zone. It is contiguous to the cemeteries, the Forest Service yard and Pierce Oil all are which in an industrial zone; Mr. Morley would propose a zone change for the two lots which would lift restriction for having ¾ of an acre for the building. There is approximately ½ an acre there now (18,000 square feet). This zone change would be a future request. The USDA would like the entire building for a regional office.  There are other agencies that may be candidates for this space and as this progresses the agencies will be contacted. Irrigation ditches need to be taken care of behind USDA building-on plat map which will be taken care of by their engineer. As the buildings are built, lighting will be added to the parking area to accommodate the lot. Staff would like to address drainage as project progresses. The Fire Chief would like to see another fire hydrant added to the East side of the project. These items will all be addressed at a later date.  A favorable motion was made by Alfred Richens for this Concept only Conditional Use Permit for Ray Morley. Seconded by Frankie Sacco. Motion carried.

 

IX        STAFF – Mayor Joe Piccolo announced the resignation of Planning and Zoning Chairman, Mr. John Angotti. The Mayor asked the Commission to suggest a chairman and an additional Commissioner for replacement. The replacement would need to be of geographic balance in order to represent Price City with quality and fairness. It would be recommended to have the names of some possible candidates for replacement by the next scheduled meeting of July 11th, 2005.  Mr. John Angotti will be greatly missed by everyone on the Commission.

           

There was no further business and Alfred Richens moved to adjourn. The meeting adjourned at 6:55 P.M.
