COMPUTER REPAIR-TYSON BRYNER, OWNER
Tyson Bryner submitted an application for a Home
Occupied Business (HOB) Office Use Only (OUO)
for a computer repair business to
be located in his home at 955 North 300 East called Tyson Bryner
Computer Repair. The HOB OUO will
be situated within the Residential 1 – 8 (R1-8) zoning district. It is
the recommendation of staff to
provide final approval with the following conditions which were read aloud
by Chairman pro tempore

No employees
other than immediate family;
·
No unusual
traffic is permitted;
·
No parking except
customary automobiles, etc.;
·
No parking lots
beyond the driveway;
·
All parking to be
accommodated on site;
·
No unusual waste,
debris, residential or otherwise to be generated;
·
No unusual
electronic interference;
·
No dust, smoke,
odors, or discharges to be generated;
·
Maintain all
applicable local, state requirements;

acceptance and understanding of

362 NORTH 100 EAST- DAVID’S
HANDYMAN-DAVID ARNETTE, OWNER
David Arnette requested a Home Occupied Business
(HOB) Office Use Only (OUO) for a handyman
service business to be located in
his home at 362 North 100 East called David’s Handyman. The HOB
OUO
will be situated within the Residential 2 – 7 (R2-7) zoning district. Mr.
Arnette stated that no signs
will be added to the home or traffic
added to the area. It is the recommendation of staff to provide
final approval with the following
conditions read aloud by Chairman pro tempore

customary automobiles, etc.;

and residents from unscrupulous business practices;

Storage of tools
in the garage (accessory building) to be maintained in a secure and locked
condition at all times finding that secure accessory buildings reduce the
incidents of public safety calls;
·
Inspection of the
tool storage in the accessory building by the Price City Fire Chief and
Building Inspector for safety finding that protection of public safety is a
primary concern of

Commissioner R. Richens moved to approve the Home Occupied Permit for David
Arnette.
Motion seconded by Commissioner A. Richens and
carried. ACCEPTANCE: The Commission

VII CONDITIONAL USE PERMIT- SERVICE
ADDITION- FINAL
159 EAST MAIN STREET-PRICE CITY
LIBRARY-NORMA PROCARIONE
Norma Procarione requested an
amendment to the Conditional Use Permit (CUP) for the
Library, located at
CUP amendment will be considered under the new
2008 version of the Price City Land Use Management
and Development Code (Code). The Library is situated within the Commercial
1 (C1) zoning district. The
existing CUP and land use will reference to
Section of the Code (books and stationary) and the addition of
coffee service will reference to,
and be permitable, under Section 11.3.4.14 of the Code. Norma stated that
the food would already be
prepared and not cooked in the library. She stated that the plan is to have an
outside vendor run their own
coffee shop from a space in the library and then the Library would charge a
rental fee for the space used. If
an outside vendor cannot be found then the Library staff would run the
service addition. Norma stated
that she would check with the City Attorney for the procedure of finding an
outside vendor. Staff recommends
approval with the following conditions:

No on street
parking by employees of the coffee service finding that on street parking by
employees contributes to congestion and no on street parking by employees
improves the opportunity for economic activity and supports the goals in the
Price City General Plan.
·
Submission of any
signage associated with the coffee service to Price City Planning Staff for
review and approval under the provisions of Chapter 4 of the Code finding that
properly reviewed and approved signage promotes conformity, reduces clutter and
blight and is consistent with the goals in the Price City General Plan.
·
Submission of a
building site plan indicating the location of the coffee service within the
Library finding that properly reviewed and approved site plans reduce the
opportunity for misunderstandings regarding land uses.
·
Completion of a
PRWID waste water survey and compliance with any resulting conditions or
recommendations finding that conditions and recommendations stemming from the
PRWID survey protect the public infrastructure.
·
Completion of
inspection of the coffee service area by the Price City Building Inspector and
Price City Fire Chief for safety finding that a primary obligation of the
Planning Commission and City Council is to ensure the health, safety and
welfare of the community.
·
Procurement of a
valid
·
Submission of any
health department certifications or approvals, as required, finding that a
primary obligation of the Planning Commission and City Council is to ensure the
health, safety and welfare of the community.
MOTION.
Commissioner R. Richens moved to approve the amendment for the Price City
Library and to
forward a recommendation to
the City Council to waive the zoning fee associated with the CUP
amendment application in the amount of
$60.00. Motion seconded by Commissioner
Shook. Motion
carried. ACCEPTANCE: The
Commission confirmed the acceptance and understanding of the approval
conditions by Norma Procarione.
