III           MINUTES OF JUNE 25, 2007

A favorable motion to approve the minutes of June 25, 2007 as read was made by Commissioner Richens. Commissioner Nielson seconded the motion. Motion carried.

 

IV           CONDITIONAL USE PERMIT- VACATE BONNIE J SUBDIV. /LOT LINE ADJUST.-PRELIMINARY -710 EAST 100 SOUTH-RICK KROMPEL, OWNER

Mr. Rick Krompel is purchasing the previously subdivided property known as the Bonnie J. Subdivision at 710 East 100 South.  Mr. Krompel is requesting to vacate the subdivision and public property dedications.  No development has taken place at the subdivision, the property has never been surveyed and has no outstanding developments agreements. To vacate the subdivision a new plat map will need to be prepared and stamped by an engineer, submitted and reviewed then recorded.  This activity is essentially handled in the same manner as a lot line adjustment. Upon completion of the vacation of the subdivision and dedications, Mr. Krompel will be seeking a zone change from RR to CD to accommodate activities planned that will service his various businesses.  It is the recommendation of staff to require proof of ownership by Mr. Krompel of the subject property as a contingency of any approval.  Upon concurrence of the Price City Planning and Zoning: Commission of Mr. Krompels’ request, the following actions would be necessary.

·         Completion of a public hearing and notice as required regarding the vacation of the public streets;

·         Signatures on the final revised plat of all affected property owners.

                MOTION. Commissioner Richens moved to approve the Conditional Use Permit to vacate the

                Bonnie J Subdivision for a lot line adjustment and to set a public hearing for August 13, 2007

                regarding the Bonnie J. Subdivision vacation of public streets at the Price City Planning and

                Zoning Commission and to recommend a Public Hearing be held by the Price City Council for the

                same purpose on August 15, 2007. Motion seconded by Commissioner Sacco. Motion carried.

 

V             CONDITIONAL USE PERMIT-REZONE- PRELIMINARY

                710 EAST 100 SOUTH-BONNIE J SUBDIVISION- RICK KROMPEL, OWNER

Mr. Rick Krompel is requesting that the Price City Planning & Zoning Commission consider a re-zone of the property located south of CJ’s Do-It-Center (former Bonne J. Subdivision) from RR to CD.  The re-zone request would accommodate uses contingent to the businesses Mr. Krompel operates including a motel, hardware store and construction company. Section 2.16 of the Price City Land Use Management and Development Code provides for the review and possible recommended approval of the zone change. To accommodate the request the Price City Planning & Zoning Commission must review the proposed zone change, hold a public hearing and positively recommend the zone change to the Price City Council, consistent with Section 2.15.1 and Section 2.15.2 of the Price City Land Use Management and Development Code. Staff recommends approval contingent upon:

·         Completion of a public hearing as required regarding the rezoning of property within the municipal boundaries of Price City;

                MOTION. Commission Nielson moved to approve the Conditional Use Permit for a rezone to

710 East 100 and to set a public hearing for 8-13-07 regarding the possible rezone of the

property known as the Bonnie J. Subdivision from RR (rural residential) to CD (commercial development) outlined in Section 2.15 of the Price City Land Use Management and Development Code at the Price City Planning & Zoning Commission and recommend a public hearing be held by the Price City council for the same purpose on 8-15-07. Motion seconded by Commissioner Richens. Motion carried

 

VI           CONDITIONAL USE PERMIT- MULTI PURPOSE BUILDING-CONCEPT ONLY

                200 NORTH STREET (CORNER) - NOTRE DAME CHURCH, OWNERS

This is a Conditional Use Permit (CUP) application for a new Notre Dame Church Multi-Purpose building. The building will be located on the southwest corner of Carbon Avenue and 200 North Street, diagonal from the Notre Dame Church building for the social activities of the church.  The CUP, concept approval is represented by Ray Bertoldi from Bertoldi Architects. The concept site plans have been submitted to the Price City Pubic Works Department for review and comment. Parking will become an issue that will need to be resolved before a final approval can be granted. A piece of property owned by the church that is directly facing this project may be of possible use for more parking as well as the Elks parking lot. Final plans will show flow through parking lot on north side. Parking will work for the concept phase for 66 seats filled at one time with onsite parking stalls. Commission will wait for more details on parking with preliminary approval. If the Elks parking is used, a deed would need to be recorded with the Elks building in case the building is ever sold in order for the church to maintain their parking agreement and allowance provided by the Elks. The project is situated within the MR-7 zoning district and is available by CUP under Section 10.3.4 of the Price City Land Use Management and Development Code. It is the recommendation of staff to provide concept approval for the project based on the following contingencies to be completed prior to preliminary or final approval:

·         Review and adjust necessary off street parking, based on Section 6.4(4) of the Price City Land Use Management and Development Code, 1 offstreet space for every 3 seats of capacity must be included (or a variance obtained);

·         Include storm water collection and disbursement plan with final site plan;

·         Driveways on 200 North and Carbon Avenue not to exceed 35’ in width;

·         Obtain letters of confirmation of utility connectivity from all local providers that will be servicing the project;

·         Complete the necessary development agreement, if necessary, with Price City regarding development and/or redevelopment of required curb, gutter, sidewalk, street lighting, fire hydrants, electrical transformers, etc. on both the 200 North frontage and the Carbon Avenue frontage;

·         Complete and submit a qualified geotechnical study of project site prior to final development;

·         Dumpster dimensions consistent with recommendations obtained from City Sanitation;

·         Obtainment of a variance from the Price City Board of Adjustment (BOA) prior to final approval of site plan relative to north boundary setback (need zero (0) ft. setback from the property line; code requirement is 25 feet) and east boundary setback (need zero (0) ft. setback from the sidewalk line; code requirement is 6 ft. minimum) A letter from the Price City Fire Chief concurring with the setback request was presented.   

                MOTION. Commission Richens moved to approve the Conditional Use Permit Concept Only as

                presented and with included requirements. Motion seconded by Commissioner Sacco and carried.

 

VII           UNFINISHED BUSINESS

                 1.  Pinnacle Canyon Academy:

                      a. Building Inspection walk through and recommendations by 9-1-07

b. All plat revisions, public right-of-way dedications, improvement design completed by

12-31-07

                      c. Completion of development agreement requirements by 7-1-08

                      d. Completion of off street parking requirements by 7-1-09

The Commission reviewed and discussed the unfinished business items and expected completion dates.

Commissioner Richens motioned to adjourn. The meeting adjourned at 6:33 p.m.
