1.                   MINUTES OF JULY 25, 2000

 

Joe Piccolo referred the Commission to Item #II, Dorothy Wilson Property, on the second page of the minutes, and requested “for the entire street”  be struck on the second contingency.  It will now read “Price City will discern when the development will take place.”  Mr. Piccolo then made a motion to approve the minutes of July 25, 2000 as amended.  Penny Sampinos seconded and the motion carried.

 

2.                   TEMPORARY CONDITIONAL USE PERMIT

Rhonda Peterson appeared before the Commission to request the use of 4 x 4     A-Frame Signs in the Price City limits for advertisement of the Carbon County Fair.  They will be up only for a week and will be located at Wendy’s and  Market Express, with the possibility of a third location. They will be weighted down with sandbags.  There were no concerns and Larry Bruno moved to forward a favorable recommendation to Price City Council for the Temporary Conditional Use Permit for A-Frame Signs for the Carbon County Fair and Rodeo.  Gary Lyon seconded and the motion carried. 

 

3.                   CONDITIONAL USE PERMIT - SIGN

A representative from Young Electric Sign Company was unable to attend and Francis Duzenack made the presentation.  He indicated that Commnet Cellular is now Verizon Wireless and they are requesting a change of cabinet and sign.  The new sign will be taller than the previous sign but will be mounted in the same manner.  There were no concerns and Alfred Richens moved to forward a favorable recommendation to Price City Council for the Conditional Use Permit - Sign for Verizon Wireless.  Gary Lyon seconded and the motion carried.

 

4.                   HOME OCCUPIED BUSINESS - OFFICE USE ONLY

Mr. Torres explained the home will be used as an office only and there will be no storage of materials on the premises.  All work will be done on site.  There were no concerns and Gary Lyon moved to forward a favorable recommendation to Price City Council for the Home Occupied Business - Office Use Only for Southeast Home Improvements Handyman Service.  Larry Bruno seconded and the motion carried.

Mr. Samudio appeared before the Commission and explained he will use his home as an office only.  His tools will be stored in the truck and there will be no storage of materials at his home.  There were no concerns and Gary Lyon moved to forward a favorable recommendation to Price City Council for the Home Occupied Business - Office Use Only for APJ Home Improvements Handyman Service.  Penny Sampinos seconded and the motion carried.

 

6.                   CONDITIONAL USE PERMIT

Ms. Gold indicated the booth has now been moved to a more suitable location at the same address.  Initially, the previous location was too close to the curb creating an unsafe condition and inhibiting traffic visibility and promoting traffic congestion.  The new location allows people to pull off the main road and safely park.  However, there is concern about people parking along Cedar Hills Drive and creating a safety problem.  It was suggested that either the booth be moved twenty-five feet back along the property line or, if left at the present location, to maintain the curb and paint it red indicating a no parking zone for some distance on both sides of the corner.  This will make it easier for patrons to drive in rather than to park along the curb.  Following discussion on the matter, it was decided to have the curb painted red 40 feet up the street and 10 feet in from the public right-of-way.  The matter of sidewalk vending was also brought up before the Commission.  Joe Piccolo asked Mr. Duzenack if a business has to be a specific business to do sidewalk vending or can sidewalk vending be done in certain areas as long as  they have a Food Handlers Permit.  Mr. Duzenack indicated he was unclear on the ordinance and would check into it and report back. 

 

All other concerns for Snowie Shaved Ice were met and Joe Piccolo made a motion to forward a favorable recommendation to Price City Council for the Conditional Use Permit for Castle Valley Services to open their  Snowie Shaved Ice Booth, contingent upon the requirement that they paint the curb red to indicate no parking will take place for 40 feet up Cedar Hills Drive and 10 feet into the private drive past the sidewalk. 

 

Gary Lyon opened discussion on the motion asking if this motion is subject to law enforcement approval or can it be done arbitrarily.  Mr. Piccolo indicated there should not be any parking in that area regardless of the red curb because of Price City Codes.  He feels this is a liability issue rather than an enforcement issue.  It is being done to deter liability that might occur because of the close proximity to the corner and limited visibility.  If there should be an accident at that location, the customer could not then say they were unaware that parking is not allowed on the corner because the  red curb would be in place.  Therefore, Price City has indicated, by the use of the red curb, there will be no parking. If they choose to disobey the law and there is an accident caused by the customer, the liability then falls on the customer rather than Price City.  There was no further discussion and Larry Bruno seconded and the motion carried.

There was no further business and Gary Lyon made a motion to adjourn.  The meeting was adjourned at 6:30 P.M.
