MINUTES OF NOVEMBER 21, 2005

III        MINUTES OF NOVEMBER 7, 2005

A favorable motion to approve the minutes of November 7th, 2005 as read was made by Gary Lyon. Ed Shook seconded the motion. Motion Carried.

 

IV            CONDITIONAL USE PERMIT- TEMPORARY LIVING QUARTERS-FINAL

            1115 NORTH 300 EAST- ROBINSON BUILDERS, OWNERS

Francis Duzenack presented this request. Robinson Builders would like to place a temporary recreational vehicle next to the construction sight of a home being built in Cave Hollow Subdivision for the duration of the construction-possibly 3 to 4 months. The R.V. will be used for sleeping only for a night watchman. No utilities will be necessary. A heater would be propane powered. The temporary permit would be allowed for the completion of the home in its entirety.  A favorable motion for a Temporary Conditional Use Permit Final was made by Alfred Richens. Gary Lyon seconded the motion.

 

V         HOME OCCUPIED BUSINESS AND SIGN FINAL

            670 EAST 400 SOUTH-PARISH RECOVERY SERVICE-MELVIN PARISH, OWNER

Melvin Parish presented this request. Mr. Parish would like to start a repossession company. This business will have an approximate 8 x 10 sign on the front of the home. The Commission reminded Mr. Parish of the sign limitations of 150 square inches. The repossessed vehicles will be placed on the property of Mark Montoya at Ray’s Auto Paint Shop. There will be an occasional need to park a tow truck in front of the house but nothing permanent. Staff advised Mr. Parish of the city code to not park any commercial vehicles at a residence. Mr. Parish has done repossession for five years in the past and will now go for his license to do so again. This home will be used for office use only with clients calling his home for business. A favorable motion for a Home Occupied Business Office Use Only Final was made by Ed Shook. Frankie Sacco seconded the motion. Motion Carried.

 

VI        CONDITIONAL USE PERMIT-BUSINESS AND SIGN FINAL

5 SOUTH CARBON AVE- CC HUMANE SOCIETY-DEANN MORGAN, PRESIDENT

Francis Duzenack presented this request. Carbon County Humane Society will do a spay and neuter clinic one day a month at 5 South Carbon Ave. The clinic runs all day on that one day a month with one doctor, a nurse and a few volunteers to comfort the animals after surgery. The few employees that work on that particular day will use public parking. The sign is an approximate 8 x 10 sign that is hanging above the stairs directly on the building and the use of an A-frame sign approximately 10 x 12 may be used one time a month. City Council would need to approve the A-frame sign use because it would be on the city right of way. A favorable motion for a Conditional Use Permit Final was made by Gary Lyon. Alfred Richens seconded the motion.

 

VII      CONDITIONAL USE PERMIT-BUSINESS AND SIGN FINAL

            190 SOUTH 2ND EAST-A.L. ENTERPRISES, INC.-DORIS MILLER, OWNER

Frank and Doris Miller presented this request. The Millers have been in business for the past seven years in Henderson, Nevada. The owners are originally from Sunnyside, Utah and have moved back and would like to bring their business to Price. This business is a sexually oriented Internet sales (only) business. The Millers feel that the revenue alone from the business will greatly help the local area economy.  The director of this business will be moving to Price and purchasing a home and they will hire 3 additional (local) people to assist with this business. The novelty item is manufactured elsewhere and will only include assembly, packaging and shipping from this location. The employees hired will receive full dental and health insurance. The product is made completely out of a lightweight plastic and was designed by Mr. Miller. At some point in the future, the Millers would like to move their entire operation from Nevada to Price and possibly move their  manufacturing warehouse here also, but that is in the future. This business will have no retail sales, no walk in traffic or displays. As long as a storefront is not set up or any product sold from this location, the Commission all agree to this Conditional Use Permit. The Miller’s have 73%  of the market and presently have a million dollar business. The product can only be purchased by adults over 21 from the Internet. Utah sales tax is charged for Utah purchases over the Internet. Staff would like a building and fire inspection done on the 190 South 2nd East location. The sign placed on the front of the building will be approximately 20 x 30 and will only have the A.L. Enterprises, Inc. with address written on it for freight companies to find the drop off address. The Miller’s are looking at the first part of December for the business to begin. A favorable motion for a Conditional Use Permit Business and Sign Final was made by Gary Lyon contingent on Building and Fire Inspections and to have no retail sales from this location. Ed Shook seconded the motion. Motion Carried.

           

VI     II       CONDITIONAL USE PERMIT-GROUP HOME-FINAL

550 EAST 400 SOUTH-TKJ INC.-JEFF HUNT-REPRESENTATIVE

Jeff Hunt and Jim Jensen presented this request. This group home will go from 3 to 4 occupants. All four residents are women, living in separate rooms, aging from 26 to early 60’s. Based on City Attorney Nick Sampinos review the Commission has recommended approval of the Conditional Use Permit for the 550 East 400 South group home. This home is approx ½ mile home from Four Corners Mental Health Group Home. Price City Code requires a ¾ mile separation between group homes. Due to the conflict between the Federal Fair Housing Act and Utah State Laws the discussion of the ¾ mile separation will need to be evaluated by Price City Attorney, Nick Sampinos. A favorable motion for a Conditional Use Permit Group Home Final was made by Gary Lyon. Frankie Sacco seconded the motion. Motion Carried.
