MINUTES OF DECEMBER 8, 2008

III           MINUTES OF NOVEMBER 24, 2008

              Commissioner Shook moved to approve the minutes of November 24, 2008 as presented.

              Motion seconded by Commissioner Lyon and carried.

 

IV           PUBLIC COMMENT ON AGENDA ITEMS- No public comment presented

 

V             HOME OCCUPIED PERMIT- BUSINESS-OFFICE USE ONLY-FINAL

                266 S. CARBON AVE. - TP TRUCKING- TONY KERR, OWNER

                Nick Tatton presented the application at the request of Tony Kerr for a Home Occupied Business

              Permit (HOB) Office Use Only (OUO) for a trucking business to be located in his home at 266

              South Carbon Avenue called TP Trucking. Mr. Kerr has been notified to park his truck off of the

              premises and advised to place a fire extinguisher in a mounted and visible location within the

              home office area. Staff recommended final approval to the City Council for the business with the

              following conditions read aloud by Chairman Bruno:

    1. No employees other than immediate family;
    2. No unusual traffic is permitted;
    3. No parking except customary automobiles, etc.; this will include no placement or parking of semi tractors or trailers at the property or on the street adjacent to the property;
    4. No parking lots beyond the driveway;
    5. All parking to be accommodated on site;
    6. No unusual waste, debris, residential or otherwise to be generated;
    7. No unusual electronic interference;
    8. No dust, smoke, odors, or discharges to be generated;

                MOTION. Commissioner Hanna-Smith moved to approve the business for TP Trucking upon the condition that a fire extinguisher be installed in his home and that he is aware of the conditions stated. Motion seconded by Commissioner Lyon and carried.

 

VI           HOME OCCUPIED PERMIT-BUSINESS-OFFICE USE ONLY-FINAL

                239 S. 200 W. - PLUS SIZE PROPERTY MANAGEMENT-PAMELA MARTIN, OWNER

                Pamela Martin requested a Home Occupied Business Permit (HOB) Office Use Only (OUO)

              for a home inspection service business to be located in her home at 239 South 200 West called

              Plus Size Property Management. Pamela Martin stated that she will only do clerical work at her

              home. The Commission required Ms. Martin to have a fire extinguisher in her home that is visible

              and accessible. Staff recommended final approval to the City Council for the business with the

              following conditions as read aloud by Chairman Bruno:

a.     No employees other than immediate family;

b.     No unusual traffic is permitted;

c.     No parking except customary automobiles, etc;

d.     No parking lots beyond the driveway;

e.     All parking to be accommodated on site;

f.     No unusual waste, debris, residential or otherwise to be generated;

g.     No unusual electronic interference;

h.     No dust, smoke, odors, or discharges to be generated;

                MOTION. Commissioner A. Richens moved to approve the business for Plus Size Management.

               Motion seconded by Commissioner Sacco and carried. ACCEPTANCE. The commission

               confirmed the acceptance and understanding by Pamela Martin.

 

VII          HOME OCCUPIED PERMIT-BUSINESS-OFFICE USE ONLY-FINAL

                583 N. CEDAR LANE-OZ PAINTING-OSWALDO LOAIZA SR., OWNER

                Oswaldo Loaiza requested a Home Occupied Business Permit (HOB) Office Use Only (OUO)

              for a painting business to be located in his home at 583 North Cedar Lane called Oz Painting. Mr.

              Loaiza stated that he will store equipment in his shed but will not store any paint because he works

              for contractors and they store the paint for the jobs. He stated that he will use his home for office

              use only and that no other employees will be in the home. Staff recommended final approval of the

              business with the following conditions as read aloud by Chairman Bruno:

    1. No employees other than immediate family;
    2. No unusual traffic is permitted;
    3. No parking except customary automobiles, etc.;
    4. No parking lots beyond the driveway;
    5. All parking to be accommodated on site;
    6. No unusual waste, debris, residential or otherwise to be generated;
    7. No unusual electronic interference;
    8. No dust, smoke, odors, or discharges to be generated;

                MOTION. Commissioner Shook moved to approve the business for Oz Painting. Motion

              seconded by Commissioner R. Richens and carried. ACCEPTANCE. The commission confirmed

              the acceptance and understanding by Oswaldo Loaiza Sr.

 

VIII        HOME OCCUPIED PERMIT-BUSINESS-OFFICE USE ONLY-FINAL

                349 E. 600 N. - SHARON’S CLEANING-SHARON KATSEVRIAS, OWNER

                Nick Tatton presented this matter at the request of Sharon Katsevrias for a Home Occupied

              Business Permit (HOB) Office Use Only (OUO) for a home cleaning service business to be

              located in her home at 349 East 600 North called Sharon’s Cleaning Service. Staff recommended

              approval with the following conditions which were provided to Mrs. Katsevrias.

a.     No employees other than immediate family;

b.     No unusual traffic is permitted;

c.     No parking except customary automobiles, etc.;

d.     No parking lots beyond the driveway;

e.     All parking to be accommodated on site;

f.     No unusual waste, debris, residential or otherwise to be generated;

g.     No unusual electronic interference;

h.     No dust, smoke, odors, or discharges to be generated;

                MOTION. Commissioner Hanna-Smith moved to approve the business for Sharon’s Cleaning.

              Motion seconded by Commissioner Lyon and carried. Staff will confirm the acceptance of the

              approval by the applicant.  

 

IX           CONDITIONAL USE PERMIT- BUSINESS AND SIGN-FINAL

                39 WEST MAIN-PILATES BODY, LAURA BLAKEY, OWNER

                Laura Blakley requested a Conditional Use Permit (CUP) for a business called Pilates Body to be

              located at 39 West Main Street within the Commercial -1 (C-1) zoning district. She stated that she

              will be teaching a form of exercise using equipment for Pilates. She stated that she will park in the

              back of the building and if she has employees she will instruct them to also park in the back of the

              building. She stated that the business will be in conjunction with Fitness World and that there are

              not scheduled hours of operation only appointments. Mrs. Blakey stated that she will only have a

              sign in the window and understands that a new sign would necessitate a return to Price City for

              approval. Staff recommended approval for this business with the following conditions read aloud

              by Chairman Bruno:

    1. All employees and owners and long-term parked customers of more than 2 hours of the business to park in mid-block public parking lots keeping limited downtown street parking available for customer parking finding that maintaining open parking on Main Street promotes improved economic activity in Price City and is consistent with the goals in the Price City General Plan.
    2. Any drop-off and pick-up parking and vehicular activity to be limited to five (5) minutes to avoid parking congestion.
    3. Submission of any new business signage plan and the appropriate fee to the Price City Planning Department for evaluation and permitting within the terms of Chapter 4 of the Code prior to installation of any signage finding that properly reviewed signage for compliance with the Code promotes consistency in community signage and is consistent with the goals in the Price City General Plan.

                MOTION. Commissioner R. Richens moved to approve the business of Pilates Body. Motion

              seconded by Commissioner A. Richens and carried. ACCEPTANCE. The commission confirmed

              the acceptance and understanding by Laura Blakey.

 

X             CONDITIONAL USE PERMIT- MOTEL DEVELOPMENT-FINAL

                720 WEST MAIN- LA QUINTA-JACK WRIGHT AND ANGELO KIAHTIPES

        Nick Tatton stated that the necessary information was not received in time to request final

       approval and recommended the Commissioner table the matter until the first meeting in

       January. MOTION. Commissioner Lyon moved to table the item with a possible interim

       Commission to review a request for final approval if needed. Motion seconded by Commissioner

       Shook and carried.

 

XI           UNFINISHED BUSINESS

                                1.  Pinnacle Canyon Academy:

                                      a. Completion of off street parking requirements by 7-1-09
